After submitting a claim with MCOL for a delayed Mytravel flight, owned by Thomas Cook, from Oct 2007 i received admission today that the flight was not an extraordinary circumstance and confirmation of payment owed. After TC denied the claim until now and not getting any help from the CAA im glad my case is resolved through MCOL with a fair outcome. Thanks to all people posting and good luck to all still pursuing a case.
Great news,I am sending MCOL to TC in the morning for a flight delay of 21 hours in august 2007, so fingers crossed0 -

I was delayed on 5 1/2 hours on a flight with TC.Sent off the template letter and received a reply 14 days later saying prove you was on the flight.Luckily for me even though it was a TC holiday I booked it at a Thomson and they were only too happy to give me my booking ref!(I had no Boarding passes etc).Sent 3 emails and one recorded letter within the next week and never got a reply, however....
Tonight I phoned Falkirk and was told the reply was received on the 16th of March and was in a long queue and to be patient as there is a backlog.I mentioned that I should have had at least a second acknowledgement, and the young chap agreed.
Question is..Do I give them any more time to respond or go the LBA route?.The guy I spoke to said hed checked my flight and no one else had claimed so was unable to give me any timescale on when my case would get looked at..is this correct?.
The flight was to Alicante on 21st August 2010 from manchester, anyone else on that flight?
gave them another call tonight,got a real snotty women telling me I would have to wait "just like everyone else" and that TC don't comply with the 28 day rule?
when I casually mentined I was considering the LBA she said "wont do you any good mate"try ABTA?
iam totally confused...help!,oh well done those successful,gawd knows how!
Just an update ,I received a call 20/07/13 offering me a voucher for £1056!.i asked for cash and they said ok......BUT you will go to the back of the queue and it could take up to 4 months!.Personally I don't trust them so accepted the voucher(valid for 12 months) and plan to use it towards a hol to the USA next year.
Keep at them everyone, and a big thank to centipede for looking after the forum:money:0 -

Care to expand on the CAA bit? Did they just simply not reply? Or did they reply and side with TC?0 -
The CAA had responded after 12 weeks to say as i had just 6 months remaining until my claim would expire that they were unable to assist as the investigation may take longer. At the time i sent my claim the wait time was 4 weeks so i did express i was annoyed to wait 3 months to hear they could not help, especially as i had called several times to chase. Very nice lady called me to apologise and asked me to get back to her with the outcome of the case.0

Just thought I would give an update..... after speaking to the not very helpful Karen ( apparently John is far to busy to speak to me ) from the Director's office, with the excuse of not being able to give me a time limit on gathering information as to why my flight in July 2007 was delayed and also dropping in to the conversation that NO ONE else has even attempted to claim comp from my particular flight (BLAH BLAH BLAH ) I then received yesterday an email from the CAA who I contacted after TC did not respond in the initial 14 days time limit I had given, so not only has it taken CAA 29 days to respond they have responded with the following " as your flight was more than five and a half years ago and we are currently dealing with a backlog of cases blah we feel it is unrealistic to carry on with your particular case as we need a minimum of 6MONTHS to deal with each individual case " CHOCOLATE TEAPOT AND USELESS COMES TO MIND !!!!!!!!!!
However this response has given me the final push I needed so this morning completed my MCOL so again like a few others on todays post's fingers crossedwithout the vital information on this forum I would never have had the confidence to carry on with this fight so a huge thanks to all of you :T

Hi. After some advice for a friend if anyone can help. Its a long thread so i'm sorry if it has been covered earlier on!
My friend was due to fly back from Egypt a week last Wednesday, however there was a problem with the plane. After a long wait, she was sent to a hotel for the night and told to come back the following day. She had travel insurance, and has sent in the relevant forms already, however she is wondering if its worth complaining to Thomas Cook too. It wasn't just the flight she had problems with. There was no reps at the airports, she was given false information on the times of the flights to return home (she has evidence) and one of the children who was travelling with her was not on the check-in details, either at Newcastle or Egypt. She had to wait in line for quite some time to try and sort this.
Any advice gratefully accepted. Basically just wondering if its worth complaining to Thomas Cook despite claiming on insurance.

Doesn't look like they have learned any lessons from last Summer, they still appear to be outperforming their rivals in 3 hour plus delays, and murdering them in mega delays. Then again its not their fault, its the ecs problem is that they appear to have 6 times as many as Thomsons, and 15 times as many as a scheduled airline such as BMI regional. If the flight was delayed by more than 4 hours, she and every other fare paying passenger on the plane should be entitled to 600 Euros each. This is courtesy of a piece of EU legislation EC 261/2004. Obviously airlines, and especially Thomas Cook don't like paying this out, and will attempt to avoid paying it. I suggest she reads the FAQs at the start of this thread, and a few of the posts to get a feel of things, and then send of the template letter (also in the FAQs), to start the ball rolling. Thanks for this. She is dyslexic so i'll read all that for her and give her a helping hand. Does the money come through the insurance or should she write to Thomas Cook? He flight was delayed in total of 25 hours so it was defiantly more than 4 hours. She had to pay for taxis, more sun cream for the kids (she left hers for the kids club at the first hotel) meals at the airport ect. Its ended up costing her a small fortune.
Sorry for all the questions.... Will read through the FAQ with her tonight at work. Just trying to find which direction we should be going in.
