    Anyway my story is Thomas Cook said extraordinary circumstance's and the CAA said they cant look at it because departure was Greece. Therefore you need to write to Greek version of CAA or go direct to Small Claims Court. Good luck.

    Does anyone know which part of which judgement shows the bit about a knock on effect not being allowed to be classed as EC's?

    Hello guys, not posted for a while and i'm looking for advice , although ive not read this chapter from start to fininsh , its on the lines of info i need.
    This morning i got off a flight from Malta that had been delayed for just over 17 hours, although TC did transfer us to a hotel, and fed and watered us, and then transfered us back to the airport, all along the reps just couldn't hold face and tell us exactley what was going on and as time moved on people were getting unsettled. When we finally landed in Manchester besides the weak appologies, we were given a letter by TC stating flight number, and times of to delay ect ect. TC are saying this is for use in claiming on your travel insurance, unfortunatley i was only covered for out going flight, my point is me and my wife lost a days pay each plus , money spent in the airport on food and drink, our dog in kennels longer the list goes on ... Do i claim from TC or except defeat because of the weak policy i took out. Sorry its a bit mumbo jumbo and spelling mistakes, Any advice please ..
    According to a piece of legislation EU 261/2004, anyone on a EU flight of over 1500Km should be entitled to compensation of 400 Euros each if the flight is delayed by 3 hours or more, UNLESS the airline can claim extraordinary circumstances. Airlines, and TC in particular will claim ecs for just about anything. 17 hours is a pretty hefty delay, and should take some explaining away. Start off by reading the FAQs at the start of this thread, read some of the posts to get a feel for things, and then send the Template letter (in the FAQs). TC will probably try to fob you off, but there are plenty of people on this site that will help and advise you, so make a start. This has got nothing to do with travel insurance, it is available to anyone flying in from or to the EU. Good luck

    Difficult to justify 19 hours as an extraordinary circumstance, read the FAQs, and a few posts, then send off the template letter (in the FAQs) . You will probably get fobbed off, but keep trying plenty of people ready to help you if you keep us advised as to your progress. Good luck

    I think you may be referring to the Lassooy v Finnair case. However this case was specifically about denied boarding knock on effects and extraordinary circumstances.

    You might be better reading up on Eglitis and Ratnieks judgment in the FAQs as that may prove more fruitful.

    I did look through Eglitis and Ratnieks but couldn't find anything appropriate to my cause.

    Depends on the length of your delay, Sturgeon talks about a particular aircraft on a particular day, so if you are delayed overnight could be a case. Eglitis somewhere in the para 24-28 range might be helpful, more or less says airlines should expect delays, and should build slack into their timetables to help cope

    hit them for all your losses,give them a clear breakdown,but do not allow them to string you along with the normal delay tactics give them a time limit and stick to it,and don't be afraid to use the mcol it's amazing how pending court action gets there attention

    Many thanks. Also does it say anywhere in any of the judgement regarding the complex engine technical issue that the airline had stated that it had not been faulty before? TC keeps making a point of saying that the valve in question had never failed before so it's an EC. I'm sure I could argue however it was due to fail so should have been replaced sooner.

    Hi, I am writing this on your last reply as I cannot remember how to post :(
    I just wanted some more advice.I sent my N.B.A. to TC and it was received by them on Friday 14th June 2013 and am now in the process of doing my M.C.O.L. I have not heard anything from them and as Thursday ( tomorrow) will be my 14 days notice, I see on Martin's page the amount of money per person now seems to read £515 per person and not the £480 it was,
    can you set me right. We were delayed 21 hours on the Belfast to Sanford flight 10.08.2007.
