Was delayed 19 hours by Thomas Cook flight from Greece to Glasgow on the 27th June - they say no compensation is required surely this can't be right?
Anyway my story is Thomas Cook said extraordinary circumstance's and the CAA said they cant look at it because departure was Greece. Therefore you need to write to Greek version of CAA or go direct to Small Claims Court. Good luck.0 -
Does anyone know which part of which judgement shows the bit about a knock on effect not being allowed to be classed as EC's?0

You might be better reading up on Eglitis and Ratnieks judgment in the FAQs as that may prove more fruitful.

Depends on the length of your delay, Sturgeon talks about a particular aircraft on a particular day, so if you are delayed overnight could be a case. Eglitis somewhere in the para 24-28 range might be helpful, more or less says airlines should expect delays, and should build slack into their timetables to help cope
Many thanks. Also does it say anywhere in any of the judgement regarding the complex engine technical issue that the airline had stated that it had not been faulty before? TC keeps making a point of saying that the valve in question had never failed before so it's an EC. I'm sure I could argue however it was due to fail so should have been replaced sooner.0 -
Two quick points:
1. It does not matter that MyTravel were independent when you flew: when TC took over, they took over all their assets and liabilities, which means they are liable for the compensation.
2. It does not matter for how long you have been corresponding with the airline for the purposes of the 6 year limit. This limit applies to your ability to bring a legal action in court. If you have not lodged the court application (MCOL or the paper form) by the sixth anniversary of your flight, you cannot take it to court. The clock has not stopped for you. It is ticking. Loudly.
Hi, I am writing this on your last reply as I cannot remember how to post
I just wanted some more advice.I sent my N.B.A. to TC and it was received by them on Friday 14th June 2013 and am now in the process of doing my M.C.O.L. I have not heard anything from them and as Thursday ( tomorrow) will be my 14 days notice, I see on Martin's page the amount of money per person now seems to read £515 per person and not the £480 it was,
can you set me right. We were delayed 21 hours on the Belfast to Sanford flight 10.08.2007.
