    you can request a cheque,i had the same, took a while for them to send it,but they did sent one in the end

    This is a blatant breach of Article 7 para 3, and as such should be reported to the National Enforcement Body as under Article 16. As under Article 16 any persons making such a complaint should expect sanctions to be applied which should be "effective, proportionate, and dissuasive " As I have never heard of an airline being subjected to sanctions, perhaps it is time to complain to MPs and or MEPS and request that action be taken.

    I contacted my MP and MEP and both didn't wish to help. It's for the courts to decide on each case.

    I did make my MEP write to CEO of TC though as I told him he works for me.

    Waste of time.

    Hi all just an update have just received a reply from the CAA and they have sided with Thomas cook they say no compo is payable in my case :( I have also just received my court date but I don't know what to do now as have to pay another £160 in fees and after my CAA letter i'm feeling a bit down :( has anyone else had this kind of CAA letter and then gone ahead an won in court?

    It is unhelpful, but not a killer by any means.

    Wasn't your delay caused by a defective engine the previous day? If so how could the CAA conclude extraordinary circumstances? What exactly do they say - can you post it here? Of course the Wallentin judgement was about a complex engine falure discovered the day before, so you're on solid legal ground in my view!

    When you win your case - as I am sure you have every chance of doing - I hope you are able to get some media interest in the failure of the CAA to apply the law appropriately.

    Though Centipede is surely right that this is not their area of expertise, they are nevertheless the NEB responsible for the full application of the Regulation regime. Failure to do so properly cannot be acceptable.

    Ok Letter sent about two weeks ago, got an email last week to say they were looking into it. Today got an email with a voucher for £2,800 (£350 x8) , no I wont ask can I swop it for cash ;) , just need to send it back and say, money please, but I cant believe how easy it was, i was prepared for a fight.

    Thanks to everyone on this site for advice etc.
