Hi,
Am about to send my NBA to TC. They are saying that an oil leak is extraordinary circs.
Few questions if anyone can help??
I am planning to use MCOL if no joy from NBA. If it does go all the way to court, and I lose..do I have to pay the other sides costs? Does anyone know how much its likely to be?
I am sure I have a sound case but I like to cover all bases!!

I doubt very much you will lose Not sure about costs on MCOL but they would be minimal if at all.0 -

Many thanks, several people have told me that an oil leak is not classed as EC's.
Do you think it matters that I haven't contacted the CAA to ask their advice - ie would the judge think it strange?

Your right. It took them 4 months to get back to me (after I chased them up) and they haven't even STARTED investigating yet as to asking the airline why they refused warning me it could take months! It already has.
As to my own claim my solicitors provided by my home insurance send a letter to them requested the compensation to be paid only for them to send a 28 day holding letter back saying they were conducting an investigation in the matter (yawn).
The 28 days were up on Saturday and have had no answer back from them so today he has sent a further NBA giving them another 14 days to comply.
I hope they DON'T respond so we can start court action asap!0 -
Thanks for the advice, I will just go straight for the NBA and see where that leads. They have already carried out a full investigation and then a full review etc etc and still fobbed me off. Bring it on!!!!!

Do you need to send a copy of the judgements or just mention them? Have had all the normal delaying tactics and letters. Need to act quickly as flight was during July 2008- 5 year claim limit in Scotland

Hello,
Just wanted to say that my cheque arrived from TC today. It's taken 6 months to get it, but I am very pleased. They originally sent a voucher which I returned and it looks like they are finally getting through their backlog from moving offices.
