I forgot to mention in my 1st query that the letter I received from TC said ' Investigations have been hindered due to your flight being taken on an airline that no longer exists. The flight in question was operated My Travel, and whilst this company was taken over by TC ( 2007) it was operated independently of the Thomas Cook Group.Despite extensive investigations we have been unable to locate the flight logs of the aircraft concerned, which would allow us to ascertain the reason for the delay.'
What are my chances?
If they can't find the logs, they must give you the money. The Regulations insist compensation must be paid unless the airline demonstrates Extraordibary Circumstances. If they can't do that, because they can't find the records, they must pay up. You'll probably have to start court action though!0 -

Hi all,
I had a look through the thread but did not see any mention of this flight so here goes:
We departed at 9am, on time. Soon after we noticed the emergency exit signs turning on and off and about. Sure enough, about 20 minutes later the pilot tells us that there is a problem and that they've discussed it with the TC engineers and decided to go to Gatwick to get it checked out.
During the announcement he told us in no uncertain terms that there is no problem with the airplane and it would be no problem taking us to Corfu but then the plane would not be cleared to depart until they fixed it which would take longer (and/or -I assume- cost more) etc etc.
So we flew back to the UK, circled around Gatwick for a while to burn up fuel and then landed normally (i.e. it was not an emergency landing- which is good) at around 1pm.
They kept us on the plane while the engineers came on board. In about 1hr we were told that all was good and the plane taxied to the runway. As we were waiting our turn the pilot tells us that the problem was not fixed after all. They took us back to the terminal and got us off the plane at ~3pm. At this point they offered us £9 food vouchers.
Then we were told that the flight would board at 5pm. Boarding started at ~6:00pm. Then with about 70% of the passengers on board, we were told that the pilot stopped boarding. After a while boarding recommenced. Once on the plane the new crew apologised and explained that after the emergency lights they discovered another problem etc etc. I asked someone that had boarded early on why the pilot halted boarding and he told me that they were told TC had discovered yet another issue. He had no idea how/if that was resolved. Or even if there was another problem to begin with.
So finally we took off and landed in Corfu at midnight local time. That's a 9hr delay. (They did feed everyone on the plane for free and offered a free drink. The food was actually very good. Better than in some regular airlines).
By this time I had missed the last ferry to the mainland (Corfu was not my ultimate destination but I figured that even if the flight was a couple of hours late I'd make the ferry. Actually even if we'd arrived at 10:30pm I would have easily made it) so I asked the TC rep for a hotel room and she said no. Despite me actually showing her the European regulation.
One more thing, in Gatwick I asked for a copy of the passenger's rights and they gave me an A4 photocopy titled: "Regulation (EC) 261/2004: Passenger Information - Delayed Flights". Maybe I'm being over suspicious but this only showed the part about being eligible for food and phone calls for delays 0f 2-4hrs, hotel if over 5 etc. Nothing on compensation. I only figured that out later when I did some googling.
So my plan now is to write to TC using the template provided here and then go through the steps. On top of the compensation I will also claim my hotel and taxi as per the regulation. If there is anyone else from that flight reading this post let me know how your claim goes. I'll report back here once I get a response.
After all this, I actually have a question. Will emailing them the letter do or is it better to send it by registered post as most people seem to be doing? Or both?0 -

Hi Anyone and Everyone, i was there to and still getting the runaround from TC the swines. I have been waiting for a reply from the CCA which i have just received, what a joke they are saying that someone else on our flight has gone through the SCC and the Courts ruled in TC favour all i can say is !!!!!!!!. I have written proof that our claims are just and now on a mission to get what is owed from these robbing and cheating gets. I have also found via searching on the internet a guy who has logged his complaint with TC and it also says it has been resolved ??????? You may remember this chap, i had a great crack with him that awful morning he was in a wheelchair and travelling with 3 girls one of which was celebrating her 40th. I have also found a forum which is dedicated to TC delays, again i have found someone on that who is persuing a claim. It seems they just keep saying no to tire you out and i guess they will have suceeded with a lot of people but they will not win with me, i am as hungry as i have ever been these lowlifes will have their day at Court with me i know who will win so if you want to join in like the page and lets all work together0 -
Further to my previous thread, could anyone please advise me if I'm wasting my time going down the MCOL route as my claim has just been rejected by TC stating that the delay of 6 1/2 hours on TCX 2103 was due to "industrial action" and therefore out of their control.
I guess this comes under "extraordinary circumstances" like so many others but just wondered if anyone out there had been fed the same excuse by TC?
Any thoughts please would be appreciated.0 -

Hi let me know when everybody is working together. I am taking them to court. They banned me from Facebook back in January, probably because I called them liars. The CAA they ignore, the Greek CAA told them to pay, they have ignored. Wrote to Harriet Green somebody in her office got back to me & told me they would reply shortly that was in February. All the papers were sent my local court 2weeks ago, we are on holiday at the moment not with TCrooks, so there could be a date when we get home0 -
I have today had a letter from tc litigation dept with a copy sent to mcol with there defence statement stating they were wrong and I am entitled to compensation...RESULT....just one slight hic up they seem to have used the details of one of our previous hols in 2009 and as far as I can remember the flight was on time...so do I now submit a new claim for my 2012 delay AGAIN...what are the chances they will pay up.....I wonder0

Mediation isn't really a lot of use unless one side gives in - almost completely however it does show you are not completely stubborn. What I cannot quite understand with your post is that if TC have admitted liability why are they going to Court?
They weren't prepared to comment on whether interest is payable and how much so I assume they are looking to the courts for this to be decided. Our claim relates to a flight from 2007 and I guess they hoped we would drop it/they could drag it out so the 6 year deadline passed. The cynic in me also thinks that maybe they want our case to go over the 6 years so if we win anyone else on our flight can't use it as a precedent to also claim compensation.0
