About 4 weeks ago, I used the template on MSE and sent it to TC.

I had no communication from them - I followed up with their customer service people, who were friendly enough, but I didn't get anywhere to even start the conversation on my problem.

I used the CAA template, wrote a letter and was about to post it..........

An email arrived, with a voucher for the full amount I'd claimed. I have since booked two flights to Tenerife later in the year - and have had the full refund using the voucher.

I have to say, it would have been a better experience with more communication, but I regard the outcome as a result!

In summary, my impression is of a helpful company, that needs a slightly better comms approach!

    :j:j

That is excatly what happened to me. But I have already booked this years jolly so the voucher is no good to me. I want the cash.:D

Thank you, If a cheque does not drop through letter box in the morning will phone. I will let you know the outcome.I mean by sending the voucher means they know I am in the right and if they duck out now I have the email with voucher to produce in court.

you may have to send to voucher back to them, when I spoke to them on the 0844 number they told me they would cancel voucher and pass it on to accounts to send cheque,i think the average is a two week wait,i hope it is not longer there as there 28 days with the mcol is up

Hi this is my first post so please be kind, having read all your posts I followed the advice you have all given and sent a letter to thomas cook re flight tcx2529 from sharm el sheikh to manchester on 22 april 2013. We were delayed 5 hours and for the first 3 hours where asked to wait outside the airport and sit on a field! We were given 1 piece of pizza each after 4 hours and were not offered any drinks until onboard the plane. However following my initial letter I received an email asking for a copy of my invoice (I had put the wrong booking ref on letter). I mailed it last night and received a reply this morning with a voucher for £1567. I am amazed thank you to every one who has posted help and advice as I would never have tried without your forum posts. :T

After months of waiting for a reply from TC regarding my delayed flight TCX 2103 (6 1/2 hours Palma to Manchester), I have today received an email from Customer Relations rejecting my claim as they say this flight was delayed due to "industrial action" and therefore the EU Regulations do not apply!

I distinctly recall being told at Palma airport that the aircraft on which we werte due to fly home was delayed due to a "technical malfunction".

    Therefore TC are totally wrong.

The trouble is - how do I prove this now? Do I just proceed and go to the Small Claims Court?

Any advice would be appreciated as I feel they are once again trying to avoid paying out on which I feel is a justified claim.

Hi there this is a simalar situation i have when we were delayed 33 hours, i am watching and reading all these posts to get knowledge and then i will be taking TC through the small claims court, they will not be able to duck and dive with their lies as they will have to give the true info as logged, good luck !!

Did TC give you the same spiel of "industrial action" too?
I had not heard of anyone else on this forum receiving that response so
I take small comfort that someone else is in the same position!

I am determined to prove my case though as I feel they are trying any old trick to avoid paying out.
