    I have had notification from the court today that TC intend to defend my claim in full!!! now have to wait the 28 days for them to file defence :mad:

    And then I was told that no comment could be made about other cases, hang on they were on the same flight sat behind me.

    Are you in contact with these other people on the plane? If they could provide you with a copy of a document agreeing to settle the claim I cannot see how they could wriggle out of that one.

    Do they always defend? They decided to defend against our claim but when we received their defence statement they admitted liability and their 'defence' was that we hadn't provided them with proof that we were booked onto the flight.... Seems they decided to defend without actually looking at the facts then found they had no defence!:doh:

    I think this was the same flight as me & mcsave. mcsave has been paid out & they have just told the court they intend to defend my claim in full!!!

    |Have you checked on the flightstats website to see if other planes were being delayed in otr out os spain on your dates. You could also contact the AESA the Spanish NEB, they looked into my case, and got a letter from them saying TC should tip up. They didn't of course, but reckon it will look good in my court case next month

    It seems to be their last ditched delay tactic by the sounds of it.

    Save your stamps, you have emailed, and written to them.Give it 28 days if no response send a NBA. It is part of their policy to fob you off, I think they hope you will just get fed up, win the lottery or go to meet your creator. 28 days if no response NBA
