    Yes looks like court but at same time pursue seeking comment from Greek Authority as they have a degree of sympathy with claimants ie run two aspects in tandem.
  • Hi, first time using this site so not really sure what I am doing. 4 of us delayed in February 2011 for 7 hours I used the template on site and wrote to Thomas Cook have offered £525 compensation not sure whether this is fair or not so wondered about others experience and whether it is worth claiming more?
  • We wrote to Thomas Cook using the guide lines after a 5 hour delay in Ibiza last year.
    We asked for 400 euros per passenger - (1200 euros total) in line with the distance/time delay and today we got a voucher to be used against any Thomas Cook holiday to the value of £695.:T
    We are very pleased with this and was definately worth writing a letter to them. Thank You Martin Lewis :beer:and MoneySavingExpert.com :rotfl:

    Half an hour after posting the message, what should drop through my letterbox but an apology for delay, due to letter printing, and a voucher for £694. I am now asking for the cash.

    Don't bother with the AESA, their opinion has no credence in British courts.
  • To #2057, I was booked on the return flight from Corfu on 3rd June and we were not told any info as to the technical fault( only a letter back at Glasgow stating 'An unforeseen operationally significant defect which required rectification prior to further flight'). We were taken to Messonghi beach resort for dinner because of the delay, 8hrs 50mins, where I got food poisoning to take home(I've only just recovered). Happy days!
    I sent off my template letter today. I assume from the wording of their statement they will claim exceptional circumstance.
    does anyone know the Scottish equivalent to the small claims court?

    The FAQ on the first page of the thread would give you all the information you need

    You would need to provide more details about your flight for people to answer your question but the below should help..

    1. Where reference is made to this Article, passengers shall
    receive compensation amounting to:
    (a) EUR 250 for all flights of 1 500 kilometres or less;
    (b) EUR 400 for all intra-Community flights of more than
    1 500 kilometres, and for all other flights between 1 500
    and 3 500 kilometres;
    (c) EUR 600 for all flights not falling under (a) or (b).

    That's unfortunate. What I really need to know is the real reason for the delay from Palma to MCR before I proceed to MCOL. TC state "industrial action" in their rejection letter but we were told "technical issues".

    How do I prove this - no joy on Flightstats? Wish I could locate anyone else on Flight TCX 2103 on 28.6.2011!
