    Hi,
Last December I reclaimed bank charges from Barclays.I'm overdrawn again and they've been charging me again, can I claim again?
    Any help gratefully recieved,
    Lyndsay

You will need to check what terms of settlement you agreed to in writing last time. Providing there is no mention of 'acceptance of future charges' or similair then yes, you can reclaim a second time.
  • Thanks Twinkly I'll check that out.

I have claimed from First Direct 3 times, so worth a try, on the 2nd and 3rd time I just emailed them via online banking and I received an offer letter of the full amount within 3 days. Goodluck x

A bit of advice please guys.

I applied for a stack of charges from Halifax on behalf of my brother and finally received a payment of £2800 (100% of charges claimed) and £340.96 (court fee and interest) back on the 7th of June. The letter we received said that they would not admit liablity but the payment was a goodwill gesture and asked us to contact the court to confirm settlement and they would do the same.

I submitted details on the MCOL site as to the settlement amount received but input the incorrect figure by 1p! meaning the claim now has a rejected status.

My question is, in between the initiation of the court case and settlement, my brother incurred another £190 in charges. I have submitted the 2 letters to Halifax with no response. I am about to submit another MCOL claim but is this the right course of action and will the previous settlement/mistake on MCOL jeopradise the claim?

Just to confirm, the letter we received had no mention of future charges and didn't require us to accept the offer in writing.

    Cheers,

    Ben

    Any ideas chaps?
  • Last spring I went through the lengthy process of getting copies of 6 years worth of bank statements from my bank. This took approx. 5 months. I then added up all of the charges = a little over £3,900 and then wrote to my bank to ask for this money back.

In March this year (11 months later) I received a letter from my bank telling me that they regretted the fact that I was unsatisfied with the charges but that they were perfectly within their rights to charge me for things such as unpaid direct debits, unauthorised overdrafts etc. and would not be able to refund my £3,900. However, as a "gesture of good will" they credited my account with £500.

Initially I thought that was fair enough but have since heard of many people going through the same process but managing to get up to 80 or 90% of their claim back.
I can't help feeling that I have been short changed.
Is this the end of the matter?
Have I left it too long now?
    Have I missed the boat?

    Can anyone help??

Did they ask you to sign anything to say you would take the matter further? Or have they sent you anything saying that if you haven't responded by a certain date then the matter would be considered settled?
If not i can't see there being anything to stop you writing a letter to them stating that you are accepting the 500 as part payment towards the 3900 and if they do not comply with this request within the 14 days you allow them (put the time frame expected in the letter to) then i wouldn't call them or write to them again to see what the hold up is just go straight to the court process.
To many times on here i see people allowing the banks to take charge of the time frame and so it drags out forever. I started my Battle of the Bank at the end of April this year, i set out the timing that i wished that bank to stick to and when they didn't i just went to the next step regardless. I received 100% of my claim back this week and didn't let them take charge of the situation once!
So be strong, go for what you want and don't be bullied or controlled by them. Just remember that you might be dealing with a big company, but the bigger they are, the harder they fall!
    Good Luck!:D

I've been paid back my bank charges but............. They are crediting my account, thing is my account has incurred charges since my initial claim.
    1. Can I reclaim these charges?
    2. Can I receive my payment via a cheque? or paid into another account?

Yes you can claim again for new charges

You can request payment by cheque but I'm not sure the bank will do that if your account is overdrawn as it sound it might be :o
