Have the banks got 8 weeks to reply?!!!

    i've gone through step 1 to see howmuch the bank owes. I've writen the 2nd template letter to the bank for my money but with no reply!!! what do i do now??????:confused:

    I assume you can prove that they received your first letter? For example you sent it recorded delivery?

    On the assumption that you can prove they received it then wait the 14 days and if you still hear nothing or the response is unsatisfactory send the letter before action telling tham that you will take them to court in 14 days.

    Stick to your timetable not theirs and make sure you can prove that they have received your letters!

    Personally, I wouldn't bother. Save your time and money. Your chances of getting a cheque for all your charges in response to your first claim letter are as slim as a size zero model. The first two letters and any replies are just to show that you have tried to resolve the matter with the bank, before you can escalate the claim to the courts or the Financial Ombudsman.

    Send the second "Letter Before Action" letter 14 days from the date of the first one. Ignore any replies, saying that they are investigating and have 40 days to respond - they are little more than acknowledgements of receipt.

    If you don't receive a full reply to the "Letter Before Action" within 14 days, start to issue the court claim. I am afraid that the days when the banks paid out in full after two well worded letters are long gone.

    I agree with most of what you say.

    However to achieve the aim highlighted in red shouldn't he/she have some sort of "proof" i.e a recorded delivery receipt, fax machine receipt whatever that he/she has done that?

    As things stand surely the bank concerned can deny receiving anything prior to Court action!?
  • 2 Weeks Have Past. My Bank (hsbc) Has Sent Me A Letter Telling Me It Has Recieved My Letter And It Is Investigating My Charges. It Said It Could To Take Up To 8 Weeks For A Response. Is That Normal. If Not Should I Go To The Next Stage And Send Them A Letter Telling Them I Will Be Taking Them To Court In 14 Days.

    It is little more than an acknowledgement letter, trying to get you to wait, get fed up with waiting and give up.

    If they haven't sent a proper reply (Mind you, that will probably just say that you agreed to the charges (sorry, fees!) in the T&Cs, so they are OK.) by 14 days after the date of letter 1, send letter 2.

    hi all, hope you can help me with something i havent a clue about. i wrote to abbey asking for 6 years of statements ( got them) totted up charges and interest and sent second letter asking for my money back... got a letter dated 1/5/07 saying that one of the team would be responsible for dealing with the complaint. they also said doing a complete investigation which could take time and that they will write to me in 4 weeks to let me know whats happening.
    well havent heard anything so i phoned them just now and the girl said that no one had taken on my case yet but that according to fsa guidelines they had 8 weeks from the date of the letter to respond...
    is this right, has anyone else had this?
    i only have £90 odd in charges but thats not the point. should i continue or give it up.. i'm scared.

    All financial institutions have 8 weeks to resolve a complaint by FSA rules.

    This, however does not apply to your reclaim and you should follow your timescale as set down in Martin's step by step guide.

    received a letter today!, their saying there going to look into it and will take 6-7 weeks!!!
