The letters that Ive sent to the banks or from this site, and tell them they have 2 weeks to reply etc.. But Ive read that some people are being told the banks have up to 8 eeks to deal with it. Whos right?
Also, is it 2 solid weeks or 14 WORKING DAYS?
I just dont want to have a go at them over the phone if they end up being right and I look like a complete idiot.:rotfl:0 -
Hi, I'm trying to reclaim my charges from natwest, I have sent the letter and statements ect, and have received a reply saying it will take 6-8 weeks for a reply, meanwhile the charges are snowballing! what do I do now? Thanks
Normally I would have said to anyone claiming from RBS, NatWest or the HSBC to allow the bank the 6/7 weeks they ask for as they would have followed through with a full offer in the time stated or at least an offer that could be negotiated on.
However, now its unlikely that this will happen so you need to follow the timescales given in Martin's article and send off the next letter after 14 days.0 -

i had an interesting conversation with my bank IF they told me that the timescale of two weeks on these template letters is legally wrong ? Apparently they are allowed 8 weeks to reply to each letter?
Is this true i couldnt understand it.
they have offered me the full amount without interest 770 but AFTER i had taken them to court and spend 120 pounds doing so (i have been claiming for interest also, this bumps the 770 up to past £1000.)
anyways anyone got any answers to this 8 weeks?0 -
They are fobbing you off and again trying to stall things, you set the deadlines.0

If you receive such a letter giving a second "date" as to when they will be dealing with your complaint this is a holding/stalling letter.
By following Martin's step by step guide you give the bank 14 days to respond to your initial letter and if no response you can send out the letter before action on day 15 and give that bank a further 14 days or you will take them to court. If you decide to file court action at either court or via MCOL you can then expect the bank to acknowledge your claim and file a defence and should read Beate's post in the Reclaim Help Thread as to the timescale for this next step.
Should your bank send you a letter giving a definate no to paying your claim or indeed if the bank suggest you take your complaint to the Financial Ombudsman you can go straight to the FO alternatively you have to have been dealing with your bank for 6/8 weeks before the FO will take on your complaint.
HOWEVER, personally, I would advise you to read the bank thread relevant to your particular bank, you'll find them all linked in the Reclaim Help Thread, as some of the banks when they say they are dealing with your complaint and will reply in 8 weeks they do in fact do this and will at that stage offer to pay the whole of your claim.
You'll also find in the relevant bank threads just which banks will take it to the wire and won't make any offer nor are open to negotiation.

ok so my first letter saying i was going to take them to court said 14days then my second letter said 7 days is this wrong???
