Have the banks got 8 weeks to reply?!!!

Can anyone advise me......I think I'm being messed about by my bank?

I'm in the process of taking the Royal Bank of Scotland to court (sent 2nd template letter 3 weeks ago) and after I telephoned them for an update, they have advised me that they are "investigating my case and that they are legally allowed 8 weeks to deal with my enquiry/claim"?

Has anyone else been told this by their bank and should I wait this l ength of time (i.e 8 weeks) or proceed now with the court letter?

Would appreciate any feedback/advice, thanks.

    I too have been told by my bank The Halifax that the Financial Services Authority gives them 8 weeks to investigate complaints, but they also state that if they are able to respond fully within the next 4 weeks they will write to update me on their progress. As this letter was prompted by my threat of court action to reclaim £1793 in charges, :confused: should I wait to see what happens within the 8 week time scale or proceed immediately with the next step i.e. actually taking them to court? I would appreciate any advice as I am finding all of this a bit daunting!

    Can anyone help?
    hsbc recieved my charges list and letter requesting a refund on 12.4.2007. I phoned them this morning and they said the process can take upto 8 weeks and that the issue should be resolved by may 21st. I need this refund to clear my overdraft urgently. Should I wait until the 8 weeks is up, or should I issue the third letter and file a claim after 14 days. Any info on this would be much appreciated - thankyou

  • Hi there,

    After reading the article on reclaiming bank charges I decided to contact the halifax and reclaim some of mine. I sent the template letter back to them (the one saying they have 2 weeks to respond) with a printout of charges and calculated interest.

    I have recieved a reply back from them but they are stating the the financial services authority gives them 8 weeks to respond to my claim and not 2 weeks like is stipulated in the template letter.

    The letter reads as follows:

    We are sorry to learn that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulator, the Financial Services Authority, gives us 8 weeks to investigate and respond to complaints.

    Our commitment to you is that we will respond to your concerns at the earliest possible opportunity. However, we want to ensure the issues you raised are thoroughly investigated. If, for any reason, we are unable to respond fully to your concerns within the next 4 weeks we will write to update you of our progress.


    Is it right that they have up to 8 weeks to respond or do I stick to the 2 weeks that I gave them in the original letter?

    I think it is the standard letter they send, I have sent them a letter stating that I will take them to court and they have replied saying they will respond no later than the 16th May yet in the previous letter they would reply to me in 4 weeks which should be the 20th April they keep changing the goal posts.
  • I am waiting to hear back from my bank. It is scary but maybe start one bank at a time so to spread the stress?!
    Barclays are very slow, they replied to my initial letter (with statements) saying they would reply by a date four weeks after, next week now. Should they have responded quicker? Should I have sent the other letter or was that only for No reply?! please advise as I am worried now! Thanks

    hi just got a letter from the halifax saying that they have 8 weeks to investigate and respond to any complaints is this correct or are they just delaying tactics thanks

    they are delaying wait 14 days and write letter threatening with court action you are on the same stage as i am keep it going don't give in
