Have the banks got 8 weeks to reply?!!!

    I recieved the exact same letters, although I have ignored them both and filed an MCOL claim, they have acknowledged it and have about another 2 weeks to defend the claim. Its just delaying tactics, just ignore them and keep to your timescale.

    I've had this in the last week and was going to post to ask about it myself. I would definitely say that it is a fob off as I had done all the investiation for them and itemised all the charges, dates and even when the odd charge had been refunded.Hope we both get a reply to this as there doesn't seem to be anything on this website or the CAG site explaining how to handle it.

    So I sent a letter to Halifax with my bank charges. A week later received a reply stating that rules set by the financial services authority that they have 8 weeks to investigate?

    Is this true?

    I would've preferred to fight then have to wait 8 weeks.

    If this is just legal talk, is their a template for a letter to demand they refund? Or shall I move onto the next stage - taking them to court?

    hi i had same letter! I sent back saying not willing to wait 8 weeks bla bla! waiting to see what they say now hopefully refund of £1400!!!

    There is a legal process to follow. If you "do your own thing" then if you get to court stage, you are in danger of being kicked out.

    There are REALLY good threads (stickies) at the top of this board to show you what to do, when how and even the address to write to.

    Follow the CORRECT PROCESS.

    I too have had the 8 week wait letter but sent letter today giving them till 23/04/07 and will be filing claim by 9am on monday for ful amount £1278.23.
    They sent all the info and have the list of charges so what is there to investigate they gave us the info.

    could someone help me please, i sent off both letters asking for statments and then asking for the money back, i received a letter back today saying, blah blah blah, they are sorry about about my resent complaint and goes on to say that the rules set by their regulator, the financial services authority, it gives them 8 weeks to investigate and to respond to my complaint, and if for any reason they are unable to respond fully to my concerns within the next 4 weeks they will write to update me on thir progress.
    i have read all the tips from martin but i cant see anything about if the bank send you a letter saying these things.:confused:
    i would be most gratefully if someone out there could help me in my next step to reclaiming my bank charges,
    thanks in advance.

    This is very common and the advice is to stick to the timetables laid out in the main article. They have entered you into their complaints procedure which has set time limits for them to respond but you dont have to follow it. :)
