Have the banks got 8 weeks to reply?!!!

hi all
I dont really no what to do, i wrote to natwest asking for my statments, they sent them to me , so i wrote back asking for them to repay the charges. i wrote back the day of the 14 days had ended saying they are looking into it its been 3 weeks now.!! sounds like they time wasting thinking im going to forget what should i do ? contact them or wait ??
any help would be great thanks

Hi iT is completely up to you which route you want to go on this, you must make sure you have read Martins advice before you take things further, give them the time they need 14 days for your first letter then, 14 days for your second then you can, Either take them to court or go with the ombudsman i am with the ombudsman and they ask you to wait 8 weeks which is what the law gives them to deal with it.

I am working with my son to reclaim his excessive bank charges due from Abbey and HSBC. I have received acknowledgment from both banks today stating that they will investigate my sons letters of overcharging, but have stated that this may take 4 - 6 weeks. Do I let them carry out their investigations, or do I continue with a second letter to the banks giving a final 14 days, then court action?
All advice would be much appreciated. Many thanks.0 -
The letters saying that they are investigating and have 40 days to respond are little more than acknowledgements of receipt and attempts to make you give up and go away. The 40 days timescale only applies if you are going to escalate the claim to the Financial Ombudsman.
If you have not received a full reply by 14 days from the date of your first letter, send them the second "Letter Before Action" letter, giving them another 14 days to respond or else you will start court proceedings.

:eek: Hi I am going through the process to reclaim my bank charges back I have sent the HSBC a letter dated 30TH April 2007 asking for my money back and 3 days later received a letter saying they are looking into it.
It has now been 31 days so I contacted the HSBC today as, they told me they have 8 weeks to send me a reply is this right????? As I though they only had 2 weeks I told them I was going to start court proceedings and he told me they (THE COURT) would not look at my case until I give the bank 8 weeks to reply - is this correct????

Hmmm depends on the bank... BArclays have said that they will acknowledge my complaint in 5 days from today (like your first letter) and then it will take them 4 weeks to make a settlement / give me an update on my complaint within 3-4 weeks.
What stage are you at?? You MUST stick to that otherwise they will fob you off as long as they can!

Sent my charges to Barclays on the 17th May, got a reply 25th May with the usual rubbish.
They aim to find a solution within 4 weeks but if they cannot do so then a full update on their progress will be sent in 8 weeks.
Do I now have to wait for the 4 weeks, 8 weeks or 14 days before I proceed with court action?
When sending the second letter do I then add the interest?

You follow your timescale as set out in Martin's step by step guide so either send the next letter or start court action.0
