Have the banks got 8 weeks to reply?!!!

    me too i have recieved the letter saying they are looking into my request about the bank charges that was about 5 weeks ago so what do i do next do i send another letter threatening legal action or do i also need to wait 56 days as well. can someone please shed some light on this situation. i could really do with the £1400 i'm asking for.also i heard the banks won a case that went to court is this true??????????. (I HOPE NOT)

    Me too got a holiday to pay for. As far as I can make out we send the next letter when our 14 days is up from asking for the charges in the first place maybe wrong not very up on this either
  • The FSA guidelines refer to making a complaint, not to the legal process of getting unlawfully appropriated monies returned.

    Like i stated the banks have 8 weeks to reply and by that i mean that they have 8 weeks to REPLY to your CLAIM. I never stated that this was the legal timescale of getting any money you may be entitled to returned to you .
  • well i spoke to trading standards and they said that by law the banks have 56days to reply to a complaint made to them,its been 42 days now since they recieved my letter about the bank charges and i have been told that i will definately get a letter within the 56day timescale,but what if i dont i know thati can complain to the FO,but what else can i do??? So has anyione given there bank the full 56days and had an offer within this time that was acceptable.

    They have 56 days to reply to a complaint. You aren't making a complaint though. You are attempting to reclaim appropriated monies. There's a difference.

    A complaint is when they breach bank procedure, going to court is when they breach the law.

    If you follow the route most of us are following then you set the deadline, 14 days which is considered reasonable by the courts.

    It is a personal choice though. If you wish to wait 8 weeks then that is your choice.

  • but i guess they could argue all day about wether im making a complaint or not but i have waited 6 weeks now whats another 2 weeks,and to be totally honest i dont have and cant afford the 120.00 court fee to start court action against them so i guess im just kinda stuck for now.

    God i sound like the bank have brain washed me argggggg

    Please don't get me wrong, what you have done isn't wrong by any means and some people have actually managed to get refunded by the use of the FO. The thing is though the FO, from a legal standpoint, is pretty toothless. They can't force the bank to pay, whereas the courts can. Additionally with the FO you do have to wait longer.

    As you point out though, it is a way of bypassing the court fees.

  • I sent Barclays the sample letter complete with a full run down of charges I wanted to reclaim, requesting a response in 14 days - they replied within 5 days saying they'd send a full report (?) in eight weeks. What do I do now? Shall I send them the second letter or wait and see what they say in eight weeks?

    According to Natwest the 8 weeks are how long the bank has to reply to your claim according to the Finance Standard Authorities.
    This happened with me and they have until the 7th June to get the settlement to me.
    Although, they have confirmed by phone the figure they will offering me and have assured me that the paperwork will be with me by the deadline.
