Little women still waiting for those court judgements you claim to gave got. When are you going to post these up?

To be fair, she never said she had any. She said she would in the future because 'that was the only option available to her'.

I got a charge from CP Plus dated 29/09 but only issued on 02/11. As per what everyone says on here I am going via the ignore route, however the letter does state something about a new law effective 1st Oct called ''Protection of Freedoms Act 2012''.

Will this have any impact or is this just another scare tactic that I can safely ignore?

Complain to the DVLA using the email below. CP Plus are in breach of their Code of practice if the letter talks about the 'registered keeper having any liability' for an incident prior to 1st October. It's simply not the case.

    email: mike.butler@dvla.gsi.gov.uk

Apart from that you can ignore the whole thing including the letters, tick them off against the 'PPC letter chains' thread link of picture previews.

  • So are you therefore saying that for incidents after 1st Oct 2012 that CP Plus or any other now have the ability to recover these charges using the Act?

Some people who run PPCs are deluded idiots and always thought they could recover these 'charges'. They usually found out the hard way in court that they couldn't as they weren't entitled to them.

Some PPC companies are run by scammers who know they have no right to the 'charges' and so always stop short of court action to save a legal spanking.

The 2012 Act will make little difference other than encourage some more of the PPC idiots to go to court and lose - that is assuming they aren't some of the very very thick PPC vermin who have managed to get themselves banned by the DVLA for gross misconduct. :rotfl:

If that post is an attempt to make PPCs' charge notices somehow more valid, then it's a pretty weak attempt.

Answer is, of course, the ability to recover the charges is exactly the same as it was before (which is pretty much all cases is next to zero). The only difference is potentially the target for recovery.

It was a question. The clue was the ? at the end

I am as grateful as the next person to CP Plus and others regularly posting me letters which I have been saving to burn now the cold winter nights draw in. It's gonna be one hell of a fire this year :j
  • Well I just got one of the newer style CP Plus letters after I was at a services in Maidstone for a little longer than their 2 hour limit. So my 'offence' was after the 1st October.

I'm going to leave it, I'll update if anything happens of course

  • I did use Legal Clampers - and they were very good. Lots of appeals processes and photographs taken, and it was not just a case of them just turning up and clamping - they were instructed to always wait 10 minutes before clamping, in case the vehicle was there in an emergency. (As Emergencies can happen). Life for the flat owners got better and disagreements stopped.

Absolute cobblers. There was never such thing as a "legal clamper", they merely avoided the radar because of rife police ignorance and one or two badly judged appeal cases. Not even before October 2012 was it legal to seize property for non-payment of an unsanctioned and impossible to register debt. The action alone contravened several existing protocols. The only reputable clamper is the one buried six feet into the earth.

That version of CP Plus' fake PCN is already shown on the new letter chains thread (post October 1st) which is hosted on pepipoo here - but please do let us know what letters follow:

In short, of course not!! That was a huge leap and assumption?!

Have a look at any of my posts and you'll see I explain to newbies every day that the new Act makes no real difference. It just means there's an appeal option (England and Wales only) that will cost a PPC money (nice!) and the PPC 'can send letters to' the registered keeper...

...and the registered keeper can ignore them just like drivers always did when they came for advice here, pre-October. The Protection of Freedoms Act has not suddenly made unenforceable fake PCNs magically enforceable!

  • CP Plus are so mind-bogglingly stupid that they will be the death of themselves. As I too am about to preside over a CP Plus waste of £32 which is non-refundable and which will not help them, I see we can all accelerate the process of knocking these swines down.

For anyone interested, it is a live post but it is the seminal contribution you want:
