POPLA Here We Go!

I am on the brink of submitting my first POPLA communication. I thought some weeks ago I'd be doing this against ParkingEye but believe it or not, when I explained the unlawful demand to them they wrote back telling me the charge is cancelled! Mind you, they didn't make it easy. Two letters from them arrived, one was the standard rejection per before October and the other was their note of surrender. Curiously, the contrasting letter offered no POPLA reference or referred to them in the way their original invoice cited Protection of Freedoms and POPLA, hence the only reason I wrote to them.

However, CP Plus sent me an invoice with the same information but they only e-mailed me with the standard letter of rejection coupled with their claim that the demand were lawfully applied - despite me throwing the book at them and explaining this was not so in my representation.

These people have given me a POPLA reference and are happy to pay for their fruitless scheme, despite the wording of my communication unequivocally pointing out that I am an individual versed in the legislation.

They won't be getting a penny out of me but who's an idiot now? ParkingEye, atleast they knew when to stop. Knowing CP Plus, this is going to happen time and time again and the communications will be nothing but templates, from ME also! :rotfl:

    The thought of them being made to look stupid in public has made my day.

    I'm not sure if I want POPLA to cancel the scam charge or for POPLA to uphold it so that CP Plus then have the added insult of paying out the POPLA fee, 'winning' and then being ignored..... I suppose either will do, £32.40 down the drain on top of what they have already wasted.

    Oh had an email from Popla today, they have taken umbridge at my website!!
    For everthing else there's mastercard.

    That'll be because it exposes them as a scam within a scam (allegedly)

    Really ? :rotfl: are they worried that the truth hurts, there is nothing there that is lies, and if they try and take it down, you could always host it in India lol

    They seem to think it infringes their copyright. Have asked for proper opinion on this from someone in the know

    Infringes copyright pmsl, love to see how that would be possible, if they wanted to ensure that they should have registered the domain, but you can always use poplasucks.co.uk instead lol

    Yeah it will be a few days before I draft it, might even push it near the knuckle just for the joy!

    Interesting point: I won't raise the issue but the signage on CP Plus boards at MOTO service stations explain that there is two hours' free parking after which charges apply. But their notice boards lack one essential detail in clarity - there is no specified time of non-return. In other words, a motorist is not in breach of contract if he drives off at 1hr 59mins and then returns, and yes this can be done because with the stations I know, I am also familiar with back road entries as used by staff buses. No way am I going to drive seven miles to the next junction, then seven back.

    So, no period of non-return? A vehicle on the land that does not leave now has no reason to given he is allowed to restart his two hours afresh once the old lot expire. As such, I see no reason to leave the car park either, and neither will the judge once it becomes clear that there is no loss to the landowner.
