  • There are No Parking Signs on the Walls of the Bin area which the hard standing is next to. When I have photographed cars illegally parked in the past, the signs can be clearly seen in the photograph of the Car.
    The more you continue to use the word Illegally, the less respect you will get from people here. You must understand the difference between illegal and plain inconsiderate. The parking problem you have here is the latter. We're not saying you don't have a problem which needs a resolution. It's just that there are alternative ways, as you are not in a position to impose "fines".

    I put the correct link below for you as the one you have doesn't work - we know clamping has been banned now in England and Wales, it follows Scotland who's had it for more than 20 years, unfortunately NI still has these vermin there.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!

    It takes time to look the stuff up you are asking.


    You only have to scan the judgements you have got. Takes bout 5 mins
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • I am sorry if I offend anyone. I don't mean to, but unfortunetly this really is illegal parking, not just plain inconsiderate. When the flats were first built 7 years ago, and problems started immediately, the police confirmed it was illegal, but because it was a civil matter they would not get involved. When I first started to use clampers, the first car they clamped, the person arranged to have the camp illegally removed. It was witnessed by one of the flat owners who reported it to the police. After a lot of discussion the police recovered the clamp which was returned and the personal concerned agreed never to park there again, and the police agreed not to pursue the matter. If the flat owners do it (which they don't) I have the power to take steps to take their flats from them. This is a last resort and not something I would do lightly without giving them lots of opportunity to stop anything getting that far. I get letters and calls from the flat owners who are unhappy that the covenants on the property are being broken by people who don't even live there.

    I have always tried to be reasonable, and find other ways to resolve the problems, but I am talking about repeat offenders not someone making an innocent mistake for the first time.

    little woman, I don't think you understand the difference between criminal law and civil law. It might help for you to begin there and then re-evaluate what you have written on this thread so far.

    No it isn't. If you think it is, name the criminal legislation under which you think this is illegal.

    Okay obviously you are not getting it, so here is the hmrc v vcs summary

    Firstly, I recommend reading the entire judgement as this puts the decision very clearly in context.

    The appeal tribunal held:

    1. VCS did not have any right to occupy land or to pursue any action in trespass (which is what VCS had claimed they were doing).
    2. Such payments they received by way of "Parking Charge Notices" were not therefore a payment by way of damages and were not therefore exempt from VAT.
    3. That on the basis of their standard agreement with landowners there could have been no contract formed between VCS and the motorist because its limited rights to access to the land did not extend to being able to offer the right to park.
    4. The signs used by VCS cannot have effect because they have no right in law to make any offer to park in the first instance.
    5. Any contract to park could only be formed between the landowner and the motorist
    6. Any parking charges collected by VCS would therefore be, in effective, damages in breach of contract or trespass but because they were retained by VCS they constituted a standard-rated consideration and VAT was therefore payable against them.

    Little woman you have no powers to take flats from people who own them, sorry but you are being ridiculous now. There is no way that can happen without a magistrates court being involved, you are not above that! Clamping was a despicable way to deal with parking, a very large sledgehammer to crack a nut, and it left a vehicle there even longer, it was a racket that definitely was illegal and has been closed permanently. As I have said already its up to the landowners now to protect their land, something they should have been doing instead of getting henchmen to swindle money off people.
