    I sent capital one a request for my charges which totalled £136 (£60 of which were £20 charges and the rest £12 charges).

    They have sent a letter back saying they will refund me the difference between the £60 charges and £12 (£32), but not the £12 charges as they are inline with the OFT.

    Does anyone know if I can claim back the £12 charges and if so, should I use Martin's second letter?

    They have given me a month to respond.

    Any help or advice will be appreciated!

    Yes send the 2nd letter. Here is another letter that I made that specifically rebutts the "£12 is in line with OFT regs" crap..

  • Go all the way, I thought I was being a dope asking questions on this forum when I first started my claim. I would like to thank Martin Lewis personally and everybody who has helped me on here as I received an early Christmas present this morning from Capital One in the shape of £1035, I originally claimed £975 and they only offered me £284.00 which was less the £12.00's and interest, I gave them the opportunity to pay me less my original claim and asked for about £600 they still refused so I thought sod it I can afford to lose £284 via the courts if I lose for the sake of the whole amount.

    Without the expertise on this forum I may never have tried to claim anything back in the first place!

    Thanks to all who have helped me, I am still in the process of claiming from MBNA and then once I receive that money I'll pay off my overdraft and then it's here I come NatWest YOU ARE NEXT!!!!!
  • I followed Martins instructions throughout from sending the first claim letter to issueing a claim via MCOL. Today I have received an early Christmas present as Capital One have paid me my full claim Yippeee! I would advise everybody to simply follow the instructions given as even an idiot like me can work them out. Initial claim was £975.00, Cap one offered £284.00 I rejected paid £60.00 court cost and today received an offer in full for £1035.00.

    Thank you to everybody who helped me on here and in particular Martin Lewis, I have paid the 50p for your song and I wish you well in reaching No.1 as my next claim is against NatWest Bank and I hope to get every penny back from those greedy pigs.

    Good luck to everyone with your claims, it is painstaking at times but it's worth it, it all comes good eventually.
