Losing heart with FO over Capital One,over 4 months and nothing. Seems like they aren't bothering to reply and FO aren't chasing them up :mad:0

If you have not been told your claim is rejected, then have faith.
My friend as just been paid by Natwest, and i have been told the FOS is about to make a ruling as Lloyds have rejected my claim. I am still confident.
Capital One is one of the few claims better done through MCOL, but i am sure you will get your money.
P.S both claims were also sumitted 4 months ago, so hopefully you will hear something soon.0 -

Thanks for the words of encouragement but I can't use MCOL as I'm in Scotland.
But I take some of it back.........got an offer this morning of £402.35 on a claim of £428.57 so close enough for me!

I'm up to the point where I need to start MCOL against Capital One but getting a bit stuck...
Sure this had been asked a thousand times and i do apologise!
Capital one offered a part payment of £202 on a claim of £660(plus £179.74 interest). I wrote back saying I would accept this as a part payment but would pursue the further £637.74. They wrote back saying they would not offer more and £202 was all they would give.
Its been a few weeks since then- been moving house and money's been a bit tight so didn't have the £60 to file MCOL. Now that I'm claiming I'm a bit confused.
How do I work out the total I know need to claim from Capital One...
Do I simply take £202 from the £839.74? but then then what do i write in terms of the interest owed?
Or do I take £202 worth of charges off my total then recalculate the interest on that?
Just a bit confused as what to put in the particulars of the case basically...
Worried too as values I claim now will be different to anything I've sent capital one before...

I didnt change anything, i claimed the full amount. After all, you don't know for sure that the amount paid will not be taken back (it won't, but thats not the point).
I claimed the full amount and full interest as originally claimed. Capital One deducted the initial payment when they paid up.0 -

I've been offered £152 on a £609 claim (with interest that is). Where do i find the sample letter which says i will except this as part payment etc but will challenge it further ......
Or should i just ask for ...... say........£500 as a full and final offer ????
I'm a bit stuck now :-/
Ya see some of it goes back to 2001 and i'm out of the time frame of 6yrs so i know i wont get back the whole £600.0 -

I'm new to the site. This question has probably been answered before. I have filled the online form and paid the money for court against Cap one but what do I do now. Am I right in thinking that they have 14days to defend and therefore I just wait?
