I don't know if anyone can help me?
I sent a letter a couple of weeks ago to Capitol one requesting my bank charges giving them 14 days to contact me. The 14 days is now up and I have received nothing from them.
I'm not entirely sure that the address I sent my letter to is the correct one. I sent it to the registered address which is:-
Capital One Bank (Europe) PLC
350 Euston Road
LONDON
NW1 3JJ
Does anyone know if this is the correct address and if not what should I do now?
Any help would be gratefully received.

They are a nightmare as you can't contact them direct only through their call centre based in India where you never get the same answer twice!!. The ERC wont take calls only mail so it's quite frustrating. I have went through the FOS for £503.03 although their recent offer amts to £381.06 so I think I may accept. Good luck0 -
I've been advised 2 letters were posted out. One last friday stating refund of £262.22 and a further one dated Monday advising of a further payout of £96, £12.00 and £11.06. Dont ask me why! Anyway can anyone advise me when money will be credited to my card as this has been going on since June!!No-one in the call centre seems to be able to answer any questions. Their customer service is appalling. Thanks0

Hi, firstly thanks for all the help I've received so far!
I made a claim to capital One for £754.00 + £221.20 interest using martins calculator totalling £975.20
Today I have had an offer from them for £284.00 plus £20.00 as acknowledgement of interest I may have incurred.
Should I accept as I'm short of cash and Christmas is around the corner plus I don't have extra money to put up court fee's etc. also I don't really understand the next process of events if i don't accept.
Any advice would be greatly appreciated.0 -

I claimed £420 back ( for my Dad ) and recieved an offer for £136. I sent a letter today rejecting the payment as a full and final payment, however I accepted it as part payment without prejudice and told them I would persue them for the rest via court. I've given them a dealine of November 30th, then I file a claim!!!
I'm persuing because I'm in a postition to do so, if you feel you need the money now then only you can decide what to do. My advice would be ( after following the amazing advice on here ) would be to go for gold. Don't let them off with it.

Check your account - they may have paid the £304 already. If so, you can use it to go further.

Thanks for your advice, just because of my current financial situation I may accept but the thought of not getting another £700 ish is eating away at me. I also wouldn't want to give Capital One an excuse for using the fact that I claimed an early offer prejudice anyone else's claim, I'm sure it wouldn't but I guess these people would try to make any sort of ground they've made up on one case stand up in court against others.

Thanks, I just checked my account but they haven't paid anything yet, it actually says in the letter they would credit my account within 7 working days should I accept their offer. A thought occurred to me that I wondered whether to ask for the difference between £304.00 and the £975.20 as an early settlement without prejudice, i.e the difference being £671.20 asking them fo a further £335.60 so totalling £639.60 to see if they would settle without going to court, is this tactic worth a go and has anybody been successful with something like minded as to avoid the court route?0 -
I filed with MCOl and the claim was served on the 16th October. Cap1 acknowledged it on the 19th October.
I havent heard anything since. Its been 24 days since the claim, so do i start judgement in four days?
I thought they paid out as soon as they acknowledged? Either way, im getting my money back :-)0 -
A quick update on my Cap 1 court case.
On 29<SUP>th</SUP> Oct I entered judgement by default with my court against cap 1 and won back approx £3300 from 3 credit cards.

Cap 1 sent me a letter 2 days later telling me they had refunded my accounts with the charges, (these accounts were all sold to 3<SUP>rd</SUP> party debt collection agencies), and that they would send me a cheque for the remainder once these accounts were paid off.

So as promised my cheque arrived, and then on the 9<SUP>th</SUP> Nov I received confirmation from cap 1 that they are applying to the court to get the judgement set aside, and are clearly stating in their witness statement that all the accounts have been paid off. However this weekend (10<SUP>th</SUP> Nov) I telephoned these collection agencies and was told that cap 1 have made no credit to the accounts, and because cap 1 no longer hold the account then the payments should have come straight to me.

So I need to call the court today to ask their advice on my next course of action, which should be recovery, I just hope that in the meantime the court don’t accept their application to set the judgement aside.0 -
I would look for a high court enforcement officer to collect on my behalf. also you must realise that there is a time limit to everything and as you have had part payment their excuse will not stand.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE.
