  • At last....I have finally won against CrapitalOne.

    I filed with MCOL which was served on the 16th October.
    They acknowlodged the claim on the 19th October.
    They defended the claim on the 13th November.
    They refunded me £185 today!!!

    Edit: What a waste of time. My IVA people say it doesnt affect anything, and i still pay the same for same amount of years. Im going bankrupt, screw this.

    I am at the Moneyclaim stage now & need some help & advice please ..

    I was offered a paultry amount by Cap 1 (£55) on a £350 claim for refund of Cr Card charges. I wrote back say the I was prepared to accept a reduced figure (25% less than I was claiming) and they said the following:

    "We're confident our fees are both fair & legal and disappointed to hear u r considering court action. The OFT haven't told us that we're obliged to refund any fees, and we've offered refunds as a gesture of goodwill!. I'm afraid I won't be refunding all of the fees as you've asked.

    Financial regulations require me to advise you that this is my final response in relation to this matter. However, you now have the option to contact the FOS within 6 months from the date of this letter"

    So based on that letter I think I should now do an online claim ....

    What's the procedure please and who should I now address my claim to???

    I’m claiming money back for charges from Cap one which total to £349.66. I received a letter from them yesterday saying that they have looked at my account and as a good will gesture they will credit my account (which at present amounts to about £450) with £120 plus £10 interest because I have been charged a few £20 amounts before it got lowered to £12. They will not refund the 13 x £12 charges I have incurred, also I have incurred an extra 2 x £12 charges since I sent the initial letter in.<O:p

    I have since sent a letter saying I do not accept the amount and have given them 14 days to pay up or I have threatened court action. Obviously I expect them to refuse so should I put a claim in now or wait?<O:p

    Also a query if at all I do win the case, will the money get credited to my Credit Card account (I no longer have a card for this account) or will they send me a cheque

  • Wait until they reply then issue Court proceedings, you will have to if you want all your money back they wont pay out without. Also, they will pay it to your card account if you have a balance on there, they will not give you a cheque but look on the bright side it will lower your debt to almost nothing. Dont forget to ask for interest and the Court fee.
  • can anybody help with this ,i had a credit card with capital one a few years ago which i did not keep up payments ,i know this was wrong but i have been paying it back and have learnt from my mistake,but capital one have since passed my account over to a debt collector ,i wrote to capital one asking for a list of charges ,when i got it i had noticed 7 charges of £18 for (over limit fee) and 7 charges for (late payment) just wanted to know if i would still be able to claim anything back ,thanks for looking

    You should be able to claim. It needs to be made with the credit card company not the debt collector. Please see the credit card reclaim guide:

    Please read the credit card successes where I have my post for Cap 1 through the FOS. Result at last after 5 long months. Fos were brilliant and thanks again Martin!;)
  • I just wanted to say to those whoare wavering about accepting Capital One's initial offer - [EMAIL="DON&#64;T"]DON'T[/EMAIL] DO IT - HAVE FAITH!

    Whilst I accept it is almost Christmas, and that a bit of extra cash would come in handy - it is a bit of a false economy, as if you can just hang on for a couple of weeks extra, you will receive the full amount.

    Hopefulyl most people won't have budgeted for having their costs and fees refunded, so any refund should be treated as a windful - my advice would be to make sure that windfall is as big as possible. That money is there for the taking - but you only get one chance!

    I truly understand the temptation, as I almost accepted their first offer too, but I held on and got the full amount.

    Just to put it in persepctive, their first offer was £336 and tey eventually paid up £1,064. Worth waiting for I'm sure you'll all agree...

    Stick with it folks, don't lose heart - keep the faith, and reclaim what is rightfully yours!

  • Following my previous post, I thought it may be helpful to provide a timeline of how my case progressed...

    13th June - Initial Letter to Capital One - Claiming £1064
    19th June - Reply from Capital One offering £336
    29th June - Letter to capital One turning down offer
    6th July - Reply from Capital One refusing to "up" their offer
    31st July - Claim issued against Capital One via MCOL
    14 August - letter from Capital One refunding FULL payment of £1064. It was paid within 14 days.

    As you can see, I wasn't the quickest in responding, so if you reply on the day you get your letters you can cut the length of the process down a bit..

    Anyway, I hope that is of interest and hopefully provides some inspiration!
