Bonjour all.
I have sent both the letters to capital one asking for my £1650 back including interest.
They originally offered me an awful £305... sent the second letter and they refused to up their offer and have said that is final.
Now I need some advice on the next steps i should take. Id like a quick resolution.
I presume i need to take them to court? If so what steps do I need to take for this? can it be done online.
Also there are alot of success stories on here especially for capital one but has anyone ever lost their case?

Nobody has ever lost a case yet. Kevin Berwick mad a bit of a mess of his bank charges case once, but he didn't lose it, he just did it wrong.. Nobody has ever lost a case against a credit card, they are much easier claims to do.
You need to start the claim now either Through Moneyclaim Online or by going into your local court & filling in an N1 form (better method imo). Then you start work on your court bundle & wait for them to cave in & deal..0 -

Hi Guys, can I still make a claim even though I have an arrangement with Cap one to pay them £1 per month? To be honest I am in the same situation with other cards so need to know what the principle is here. Ta0

Yes you can still claim but any payment that you get back will usually go back into your account to pay it off.
On a brighter note I finally got a cheque from Cap.1 today on my claim that I started in July so don't have to have anything to do with them again! :j0 -

Congratulations for that. Were they okay to deal with? I've just looked at my statements and found there is PPI on there, so will have to try and claim that back to.0 -
I just wanted to let all those people who are just starting sending the first letters that it is so worth the cost of a letter. I sent both letters claiming £1350 from Cap 1. I then filled out the MCOL. They had until next week. They did intend on defending claim. I received a letter yesterday saying they would be refunding the full amount. Not bad as I only sent the first letter in November.
I was also about the fill in the MCOL on behalf of my hubby against Barclaycard. They asked for extra time to look into the matter but offered a small amount. I was amount to proceed when I got a letter yesterday saying they would refund the full amount.
Two successes in one week!!!!

Can't help you I'm afraid as my account was already paid off - but don't seem to remember reading about people saying that their accounts had been closed.
Gigsy - to be honest they were a complete pain but once you start court action/mcol then they 'cave in'. I went down the FO route which is why it took so long but I got the full amount back.
