  • I sent capital one a request for my charges which totalled £209. i have recived a leeter of them today saying, why fees are applied and when i opened the account i signed an agreement to their T&C

    they say as a matter of good will they will reduce the fee's they added to £12 each and that they will only refund £65 (not£209) and that they are in line with other competitors.

    should i acept the £65 or send the second letter to get the full amount?

    No accept as part payment by letter and push for the full amount and go through the FOS. I did this and received full payout. Good luck!

    with out sounding realy dum, what is FOS? will i need to call cap one to tell them im only accepting the £65 as part paypent, as they said in the letter that they are going to pay it in to my account and it will show on my next statemaent.

    Sorry for the abbreviation! The FOS Is the Financial Ombudsman service. You can download a complaint form from their website. They are very good and liase with the bank on your behalf to come to a settlement. It takes a bit time but the outcome in my experience is always successful. I claimed through them at the end of June and the money was with me by December.It can be quicker though depending on the backlog.They charge the bank I was told for the investigation. Hope this helps. I would write a letter to Capital One stating you'll accept their offer as part payment and that you will be going to the FOS to reclaim your full amount. Dont phone as it is frustrating and they just tell you to put it in writing anyway to the complaints team.

  • Good luck with the FO but don't hold your breathe for a result - sent them a complaint form at the beginning of July and today I have only just received a 'Capital One say their charges are fair and won't pay you so we have to investigate further'.
    In my experience Cap 1 drag it out as long as they can and the FO don't really seem to be chasing them up for any replies. And before anyone says it yes it is quicker to go to court but not being able to use mcol is a problem - mind you since the limit for small claims has been raised in Scotland from this month I'm debating going to court. Just not sure if it is worth it after coming 'this far' with the FO. :confused:
  • Keep Going!!! After the "investigate further" letter things move along quite quickly as in my experience the bank doesn't like when they investigate further. You are nearly there! This is the same that happened to me. The backlog is what has made things slower. They really are helpful. Good luck

    Hello peeps :wave: hope Sunday night isn't a wet and rainy one for all of you out there, like it is here in Wales....:eek:

    Anyhoo just a quick question and possible blond momento (ahem) :rolleyes: :rolleyes: :rolleyes: :rolleyes: - when you lodge MCOL online and they ask you for the defendants name and address is it Ok to put the name of the bank and then their address?

    I'm just about to make Crapital One `ave it' online so do I put that and their address or the name of an individual (worried because I don't know anyone at the bank) and then the bank's address.

    Thanks everyone for your help so far - I have 13 claim backs to do over the next couple of months! Mental or what?:eek: :eek: :eek: :eek:

    yep put capital one as defendant and the the address youve sent the previous letters to.

    ive taken them to mcol and they should defend by saying theyve paid. wait till they do then inform the court and thats one less you have to do :-)
