We recently wrote to Capital One asking for a list of charges on our credit card. My husband only had a £200 limit and ended up paying hundreds cos of charges. we paid this off in 2005.
They have sent us a list of charges, but we dont beleive the information is correct, could they do this? For example. for about an eight month period, there is no charges or late payment fees or even interest added, even though we are over the £200 credit limit. Then suddenly they start adding on the charges. It just doesnt ring true. Are we allowed to ask for actual statements as opposed to just a list of charges, which to be frank, could be any figure they decide to put?
Also at the very end, they have credited a 'goodwill' gesture of about £1000, I guess this cancels out any charges which we could reclaim.
Sorry about the waffle, I am new to this forum, but would be interested to hear from anyone, and where would I go next to if Im not satisfied with what Capital One is saying?0 -
I have a Capital One credit card which is set up to take the minimum payment each month by direct debit from my Nationwide account. In December I went slightly over my limit and so was charged on 7th Dec a £12 overlimit fee. The minimum payment by direct debit was then taken from my account on 13th Dec however Capital One chose not to include the overlimit fee in the direct debit. I did not receive my monthly statement for the 20th December from them and so was unaware I was over my limit. Now on the 4th Jan another £12 overlimit fee was charged. It then gets worse, because a recent employer did not pay me on time my January's direct debit was returned, incurring a £30 charge from Nationwide and then a further £12 returned fee from Capital One. Capital One have then proceeded to charge me another fee of £12 for late payment.
What makes me angry about most of this is that Nationwide charge me £30 for 'computer says no' in regard to the direct debit, but then Capital One try and cash in on it by saying you can pay us £12 too rather than 'ok, it didn't go through so please pay us by another means.'
So, is the company receiving the direct debit allowed to charge a returned fee as well as the bank?0 -

credit card charges are still being payed back. bank charges are pending the OFT test case. thats a lot of charges in a short time. the late payment on credit card will also affect your credit rating a bit.
capital one will probably refuse to repay until you take them to court when they will pay you back in full (uptil now the future is as always unknown)

I wondered if anyone can help me again!
I am in the process of claiming from capital one for £12 charges totalling £136, they have offered £8.00 which I turned down and have now received a letter saying that £8 is their final response in relation to this matter and that I now have the option to contact the FOS.
Does anyone have a precedent letter or should I go to the FOS? Someone helped me last time with a 2nd letter, so any more help would be appreciated.

HI Everyone, I just need a bit of advice really.
I filed MCOL against Capital 1 on the17th of this month.
In your experience how long does it take them to respond the my claim and what is the normal outcome?
I have filed for £1800 so im like a kid in a toy shop waiting to see what happens!

It took two weeks for Cap 1 to inform me that they were defending claim and then another two weeks to inform me that they were going to refund all the charges. I received the cheque last week.

I have accepted Capital Ones charges back, it has been a at least 4 weeks and have still not recieved my cheque.

How did you go about getting them. Did you go via cap1 or the courts. My guessing is if you went through them they ahve offered a reduced figure.
