Hi,
I had an account with capital one that had over £1000 of charges (initially I never went over my limit but was late in paying as they couldnt take payment over the phone due to an error on the system at their end!) anyway the charges spiralled out of control while I was disputing them the whole time..I made an arrangement with capital one where I paid £880 of charges & they 'wrote off' the £267
(looking back I never should have paid it but i was afraid that if they took me to court as they said they would i would have to pay even more ) ..anyway
cutting a long story short..I have submitted a claim for £880 in charges from capital one.
They have offered me a settlement of £398 (the difference in the £12 & £20)
But heres the sting in the tail.. If I accept the amount..they are going to take the £267 that was allegedly 'written off' out of the £398 so I am actually being offered in real terms the amount of £131! even though I have paid £880 in charges.
While at least it is something & I am not greedy it seems a bit like they win all ways.
I am not sure what to do for the best & also worried that If i dont accept the offer that will refuse to pay me anything back & then chase me for the £267 that they are now saying that I owe tham?
(had a conversation with them this am where they told me the amount of £267 is now owed because I have claimed)
Anyone have any advice?

Thanks so much for the advice everyone on not accepting!..I contacted the FO who dealt with my case really quickly . I included interest worked out on this site & total came to over £1000. Capital One agreed to pay up rather than agree to a formal investigation & although they have kept their alleged 'owed amount' of £267 they have sent me a cheque for £800 so far thanks to the fO..Anyone who reads this post Please Don't give up or accept the first offer!0 -

Hi Tracey.
You can claim back all the charges.... just ignore the awfull offers they make you and take them to court on MYCOL. It doesnt take long to do and is definately worth it as capital 1 always defend and then pay the full ammount.... I just got my payment today so its so worth it.
you can soon be £880 better off!0 -

I fought Capital One through the Financial Ombudsman which took 5 months in total but I also ignored all other offers and got the full amount in the end. Don't accept anything less. Good luck!0 -
Hi everyone,
I wrote to CapitalOne, claiming back £208 in charges. I received a reply today with an offer of £64. This is only the difference between all the £12 and £20 charges, so basically they're just reducing the £20 charges to £12.
Would you recommend cutting my losses and accepting the £64 or is it worth going for the full £208? Has anyone had any success doing this with CapitalOne?0 -
No! Don't accept it. I got a similiar offer, followed all the steps as on this site, went through the Financial Ombudsman and got full amount plus interest. Don't give in at this stage.0

I've decided to claim back my charges from capital one. I am always over my limit and each month have an overlimit charge. I havent missed any payments and pay by direct debit but like i say I am always over my limit so getting charged and can never get back in the black as I cant afford to pay more than I am already!:wall: :sad:
Do capital one charge £10 to send out lists of default charges? After reading a few posts from a year or so ago they werent charging!?
Also should I phone to ask for my statements or is it best to write the letter?

Just like the advert for guinness - good things come to those who wait.
Started my claim against Capital One back in October 2007, claimed £830 in charges plus 8% interest. Had usual letters from Capital One with final offer of £310. Decided to refer complaint to Financial Ombudsman in December 2007. Have just been informed by FOS that Capital one would like to settle my claim and pay me the full amount of my claim rather than have an investigation from the ombudsman. Now just have to wait for the cheque to come ( account was closed nearly a year ago).
So anybody that's s tempted by Capital One's final offer, stick to your guns they will pay the full amount (or close to it) eventually. :j0 -
Am I the only one who hasn't had luck with Capital One thru the FO???
Started my claim July 2007 and still no 'reasonable' offer from Cap 1 - FO don't seem to be chasing them and even said I had to contact Cap 1 again as they are now paying out on claims therefore FO aren't needed!!! :mad:
Sent my cheque away to my local court last week.............0
