You have to file with your local court, MCOL are automatically staying all claims relating to charges.0 -
I referred my claim to Ombudsman in December - Capital One have decided to pay my claim in full together with interest.
So my advice would be to pursue your claim either through the courts of via the Financial Ombudsman (just takes time) - you will get the full amount either way.

Did you get back the £12 fees as well, though, or just the £8 difference?0 -
if you take cap one to court they pay up all the fees not just the difference!Make £11,000 in 2011 / ebay £6000

Capital One paid the full charges including the £12 ones.0 -
I have sent all the templates off to Capital One and had a low offer made which we refused so sent off the next letter. They have now replied to say that was their final offer and arenot prepared to offer anything else. Is it better now to go to the financial ombudsman or to start court proceedings?0

hi start court proceedings that is the only time they pay up they will say tht they are defending, but then they will pay you it all .Make £11,000 in 2011 / ebay £6000

one account i have tried claiming charges and they so far have only refunded the difference between the charge and the £12, shou
ld i persue thru courts now?? Also on this account i wrote regarding mis sold PPI as i was not told it was optional (also put on form i was a student/homemaker). They have sent copy of form which shows i signed for it, so is that it?? does that mean theres no way i can claim i was mis sold it??
Also on this account which is still as far as I am concerned in dispute re the charges and PPI they have sold the debt to debitas, can they do this when they are aware i am disputing the amount??

I'd had a couple of problems in the past with this bank. Money which was paid in to clear a balance wasnt credited to my ac until several days later. This meant that an interest charge appeared on my next statement, whereas if the money had gone into the ac in a properly processed transaction there would be no interest to pay.
The first time is when they claim to have not received a cheque until several days after it was posted. It was eventually credited, but not until after the payment-due date.
The second time was a BACS transaction online. The money disappeared into a holding ac, and didnt turn up until 3 weeks later. The excuse this time was that the beneficiary was given as my name instead of Capital Bank. The sort code + ac details were correct.
Now, a building society has made a payment to them on my behalf. Again, the money went missing, and turned up 13 days later, youve guessed it..after the payment-due date. Cap1 tells me that the BS provided insufficient info for the payt to be processed, but the BS has written to me insisting that all relevant details were correctly provided.
I am now of the opinion that monies are deliberately being delayed by Cap1 so that on the next statement date they can add an interest charge, which is in the region of £80 on the balancedeemed to be outstanding.
Anyone had a similar experience?0
