If you can afford to wait, then the FO carries more weight (sorry, pun unintended)- the card co's will be 'scared' into doung something..
and i reckon it doesnt look good for them, if they go against any FO judgement / recomendation,,?Long time away from MSE, been dealing real life stuff..

My first letter asking for repayment of charges was sent on 24th October 2007. I referred my complaint to Financial Ombudsman on 9th December. Received letter from FO advising Capital One were offering me full charges plus interest on 8th February.
Should get cheque from Capital One within 6 weeks - . Will be another complaint to the FO if they dont pay up within the six weeks.0 -

I tried reclaiming money back from CapitalOne which included every £20 and £12 fee they've charged me. They replied saying that the only offer they'd make was £64 (the total of the £8 differences, so every charge is now reduced to £12). I replied, rejecting this offer, and got another response today saying that the offer is still open but that it will not be raised or improved upon. The next step is to take it to the Ombudsman and to court. Do I have a case for doing so or should I just accept the £64? The total I originally asked for was £208.0 -

hi if u do mcol , ull get all ur money back sooner than going threw the ombudsman so i would go for the full amount cos u will get it all back , good luck jill0 -

I claimed from Capital One, they offered the difference between the £20 and the £12, I held out, issued the court papers and they gave in and gave me back the full amount plus interest.
The court case as the moment doesn't deal with credit cards, so it's ok to carry on with the claims0
