    It's not a conspiracy, although it may feel like it to you!
    The first time is when they claim to have not received a cheque until several days after it was posted. It was eventually credited, but not until after the payment-due date.
    The reverse of your statement will tell you how long to allow so as to ensure your payment arrives - and clears - in time. This mishap could easily be explained by postal delays (outside the control of Capital One), or cheque clearing times.
    The second time was a BACS transaction online. The money disappeared into a holding ac, and didnt turn up until 3 weeks later. The excuse this time was that the beneficiary was given as my name instead of Capital Bank. The sort code + ac details were correct.
    Everyone with a Capital One card probably shares the same sort code and account number (called a 'collection account'). The thing that identifies your particular account is your 16-digit card number, and it is this - and only this - that should be placed in the 'reference' field. Your payment would have been held in a 'suspense account' until such time as they were able to identify where it was supposed to be credited.
    Now, a building society has made a payment to them on my behalf. Again, the money went missing, and turned up 13 days later, youve guessed it..after the payment-due date. Cap1 tells me that the BS provided insufficient info for the payt to be processed, but the BS has written to me insisting that all relevant details were correctly provided.
    Register a complaint with both parties and see who owns up!

    It's not a regulating body, but you can complain to the Financial Ombudsman Service (FOS). However, they won't entertain your complaint until you have exhausted the provider's internal complaints procedure and received a deadlock letter (or no reply), which may take up to 8 weeks.
  • Hi I'm really hoping someone can help. I've in the process of claiming back charges from Capital One. I've received an offer of partial payment (ie. the difference between £12 and the actual amount charged on each occasion). I want to go to the FO to get the full amount plus interest but it's only been about a month since my intial letter requesting a refund went to them.

    I know on Martin's advice, he says to wait 8 weeks after the first letter or until the bank has sent a "final offer". Does this "Complaint Settlement Form" constitute a final offer or should I wait another month before going to the FO?

    Confused! Any help would be gratefully received!

    hi

    having claimed from capital one i would suggest starting mcol as they then pay up in full with interest including the court fees. if you find the capital one thread you will find this is the normal process.

    all seem genuine mistakes of one sort or another. rather than profiteering would be good for the credit card company to accept its a mistake and refund as it would seem appropriate.

    i would add that you should find out what has been recorded on your credit files as this could have serious long term implications over and above the immediate interest and charges.

    Hi there,
    Just started claiming back all I can from everyone I can as I think the charges are gonna clear debts and give me change. Capital one have just sent me all the statements which all seem to be fine.

    They have also sent me what I can olnly explain as pictures from an internet explorer page. It has what seems to be a list of coded words that relate to conversations we have had and about the third party involved(debt management)why have they sent this and has any one else had them

  • Finally got an offer of full amount back from Cap 1 - 9 months,FO intervention and a court summons later. But they refuse to repay court fees as they say it isn't their policy.
    From reading other posts I think this is a lie, can anyone verify this?

    We have just put in a claim for Cap1. Hubby owes £300 on the card but all the charges amount to £1135 hat includes 8% int. Looking at this though I dont really rate our chances.

    Yes you can. Just write in with your details and ask for the statements. They are very slow in my experience and will try to fob you off but persevere as I successfully reclaimed all my charges within 5 months through the FOS finally. Good luck!

    You will manage to reclaim this in my experience, just follow the steps and don't take no for an answer. Finally contact the FOS if you get stuck after 8 weeks as I did this and got a full payout eventually. Dont give up, good luck!!!
