  • Am I the only one who hasn't had luck with Capital One thru the FO???
    Started my claim July 2007 and still no 'reasonable' offer from Cap 1 - FO don't seem to be chasing them and even said I had to contact Cap 1 again as they are now paying out on claims therefore FO aren't needed!!! :mad:

    Sent my cheque away to my local court last week.............

    I had a Capital One Card from 2002 to 2005.

    Being young at the time, I ran up a lot of late payment and overlimit fees.

    In January 2007 I decided to find out how much it came to and was surprised to see that it totalled £1079 in charges over the 3 years.

    I sent them an initial letter in March 2007 asking for it back. They refused. I sent another letter at the end of April 2007 telling them that I wanted it back or I would take it to court. They offered me £296.
    I refused this and sent my LBA to them stating that I would take them to court if they didn't refund the lot.

    They refused again so I sent off the details and copies of the letters that I had sent and received to the FO. That was in September. I got an a couple of letters from the FO during the next 3 months stating that they were awaiting a response from Capital One and that they would let me know when they had had a response.

    First week of December I got a letter from FO saying that they had offered to repay the full amount £1079 plus interest. I confirmed my acceptance and a cheque arrived the 2nd week of January.

    So don't give up. It took nearly 9 months from start to finish, but it was only 5 letters and a phone call to get back £1100+.

    The financial ombudsman should reach the same conclusion on all cases regarding overlimit and late payment fees with Capital One, it might just take longer for them to get round to paying if its a larger amount.

    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08

    Yes but at the time the amount was too much to go through small claims in a scottish court - the limit was only raised in January!

    Wrote asking for Last 6 yrs statements , sent off Template Letters ,got runaround ie - only pay difference between £12 / £20 :mad: Sent letter saying thanks but no thanks ! Got their letter saying its our final offer - Took it to County Court ,started proceedings 22nd Jan , recieved a letter this morning stateing ,Dont want to go to court ,we dont accept liabillity, but we are sending you a Cheque for FULL amount :j so hopefully within 21 days Loadsa Money LOL

  • i had a capital 1 card a few years ago ,couldnt pay and got hammered with charges.my amount was about £470 owing,i partially settled which they accepted and i paid them £350.i sent my letter askiing for my charges back,i got a letter of them saying because i only partially settled,they would refund my charges which will be used to pay of the rest which i owed,what was made up of charges anyway,should i accept this or write to them again saying the money was also charges.any ideas thanks

    I'm sending off my letter asking for my charges to be refunded and want to confirm the address to send it to. Is it Capital One, 350 Euston Road, London NW1 3JJ?

    Good luck with your claim - persevere they will pay out eventually, you will have to go to court of the financial ombudsman but they will pay out.
