  • don't worry i did that with egg, so i just resent the letter asking for my charges back and started it all over again, they paid up in full.

    i'm going after cap 1 now, and recieved a letter this morning saying as they only ever charged me £12 each time, they are not paying back my money, so here comes another letter me thinks haha

    i sent my letter asking for all my money, i today recived a letter off capital one (at last!!) stating that as i was only ever charged £12 i can't claim anything back!
    is this right??? i have a feeling not so do i just send the second letter in now??

    Have dithered for a long time over taking Crap 1 to the cleaners with one thing or another getting in the way and delaying it. I am in the process of relisting all my charges. Was wondering whether FOS or MCOL is the quickets way to go. Any ideas? Also hubby had an offer of them through FOS some months back but has incurred a few £12 charges, can he claim these back also??

  • Hi dont know the answer to that but i would do mcol as you can keep a check on it also do it today as then you havent wasted a day cap one will pay up as soon as they put in a defense i think it is about 10 days after they get the court papers gl!

    Hi,

    I took the MCOL route. They acknowledge the claim and said that they would defend. I then received a letter saying they would refund the full amount. It was really easy. The process from completeing the MCOL on-line to receiving the full amount took about 6weeks.

    I presently doing the same thing against GMAC. I only hope that it is easy with the GMAC horrors.

    I have just gone back through my online Cap 1 statements and have ammassed £106 in £12 OverLimit and Late Payment Fees going back to Oct '07. Any further back and the online statement simply says "no transactions for this period" which is bull but nevermind for now.

    I've had this Card for years and have paid charges regularly.

    Can I make a claim for all the individual £12 charges ? Or is this charge amount acceptable after 2006 ?

    Yes you can claim. The FSA did not say that a £12 was acceptable as the banks etc will have you believe, they stated that charges over £12 were unacceptable and would be looked into.
    £12 is still too much and they know it!

    Hi a bit confused on what to do next sent all template letters to cap one and finally got a reply this morning offering 625.00 on a 2000.00 claim i am going to go through fos to get the rest, but do i sign the acceptance form as it says they will judge the complaint to have been dealt with if i sign it.Any advice would be welcomed.Sorry pound sign not working.
