    Must be something about Capital One, they said that they didn't recieve my cheque !!! Promptly cancelled cheque and resent letter - now waiting on statements (again)

    i claimed bk just under £300 worth of charges from co last summer but since then they have charge me again can i claim again???
    i have sent them the 1st letter but they replied saying they wouldnt refund again should i send the 2nd letter threatenin court and see wat they say an if they dont pay up tek them to court??

    Yes, you can claim again.

    They may throw you out though.

    how come you went the FO route and not court? just wondering as sent my 3rd letter adn now need to decide my next course of action in case they say no again (offered just less than a 1/3 of what i requested back and i refused it)

    Reading from the posts, it seems that cap 1 will pay out, i dont know if my situation is different but would like to ask a few questions.

    1. If they agree to pay charges back, does it just go to pay off existing balance!! If there is no balance do i recieve the funds?

    2. Will they close my account during the process or when evrything has been sorted?

    Hi

    Please bear with me as this is my first post :)

    After reading all the posts regarding claiming back charges with Cap 1........ what is the time limit for claiming these back?

    I had a Cap 1 card about 7yrs ago, and for various reasons, I fell behind with payments.
    I am currently receiving letters from a credit collection agency asking for payment of £420....... my limit on the card was £200, and I know it was the charges that took me over my limit in the first place.

    What I would like to know is.... is it too late for me to ask for refund of charges or would I be in time if I did it immediately??

    hi ya if u have an outstanding balance they clear that and then send u a cheque if there if more that they owe. i claimed last year and they never closed mine.x

    Lyn1969 - If it was over 6 years ago and you have not been in contact with them in all that time, the debt is more than likely statute barred. I would check all this out before I communicate anything with them. If you communicate with them the whole 6 years starts over.

    If, however you have been in contact with them already then you're right it would be a good idea to get your charges back. Good luck.

    although I havent actually been in contact with them, I aqm still getting letters from the collection agency. I have not acknowledged any of these letters tho, maybe was a wise move,
    They only found my new address after I had enrolled on the electoral register 2yrs ago, despite me requesting to go on the "edited" version!
    Think I might just sit this one out and see how it goes lol.

    I know I have to tackle Alliance and Leicester tho....... I went o/d by £1.37 last year and havent been getting any statements from them for over 12 months........ got a letter last week saying I now owe them nearly £300!!
    no chance they getting that off me lol

    Has anyone managed to get the charges back if they are only £12? ive just got my statements through this morning from capital one and the charges are £12 not too sure if to claim them back or not.
