    Hi There,

    I have had my letter from capital one to say that the money they are offering me is their final offer. I want to take the next step, ie small claims or FOS. I am in Scotland, so I know that the most the small claims court will award is £750.00. I think that I can use the small claims in England but not the moneyclaim service that is available online.

    I am after £1200 from them, they have offered £210.

    Can anyone help?

    Put your complaint straight to FOS now and just wait. I did this and successfully got what I was due with Capital One after a similar offer.They are slow but result in the end for me. Good luck
  • I recently applied to Capital One for refund of charges of £772 plus interest of
    £140.32. Today i received an offer for £172 plus £10 for interest.

    I have decided to take things to the next stage threatening to take them to court but was a bit puzzled with regards to the list of charges i need to include with the letter.

    My question is do i need to re calculate my charges with the newly accrued interest or do i claim for the original amount. The interest may have changed slightly as it was 2 weeks ago since my original claim.

  • Thought this might help a few people requesting a list of all default charges applied to your account without the need to pay for £10, register online with capital one with your credit card, in 'Account maintenance' section click on secure messages, scroll down to interest, fees, and charges, and tell them that you want a list of all the default charges you have incurred in the last six years, I done this yesterday and got a reply back saying that they will send me a list of all the charges put on my account in two weeks. I will see if i get the statement in two weeks if not the old fashioned letter is the only way.
    Bank charges Reclaim:
    Capital one (c/c) = Won - £687.00: 8/2008
    Cahoot C/A = £1300 pending until court case:rolleyes:
    Natwest (C/C) = Caliming £276 = won £276 Feb 09
    Baclaycard = Not Started-Cahoot (c/c) PPI Won £520

  • I am in the process of claiming £216 worth of charges, plus interest from Capital One. I have just got back a reply from my original letter offering me a 'whopping' £48, that being the difference between my £20 charges and the lower £12 charge which they deem to be fair. I don't think so, 2nd, more threatening letter winging it's way to them now....

    As your probably aware the OFT hasnt challenged the rights of banks to charge default sums, but merely the amount. Allthough we feel £20 is a just amount we have reduced our default sums to £12. Ive reviewed your account and find that the default sum added to the account were charged at £12. I cannot therefore refund any of these default sums.

    Has anyone elce recieved a letter like this? Did you continue to claim? Its for about £72. What should I do?

  • I had a Capital One card and closed the account over 3 years ago. I can't remember the full details of my account but I was definately charged alot in penalty fees etc. Last week I received a letter from Capital One saying that they owed me £20 !! Apparently when I closed my account 3 years ago I overpaid by £20. When I called them about this matter I asked if they were going to pay me £25 a week late payment fee for having my £20 for the last 3 years, they laughed, said no and sent me a cheque for £20. I have not cashed the cheque because I feel I have a right to either claim back all my charges that I paid them or ask them for either interest/ charges on my £20. What does anyone else think. Is it worth fighting??

    Hi,

    I'm going to make a Subject Access Request to Capital One but I'm not sure which address to use as I've found contradictory information in previous threads and also on a different forum.

    This is the address that Capital One have registered on the Data Protection Public Register (which apparently is the one I should send the SAR too):

    CAPITAL ONE BANK (EUROPE) PLC
    350 EUSTON ROAD
    LONDON
    NW1 3JJ

    But I've read that people have sent their requests to this address instead:

    Capital One Bank (Europe) plc
    Trent House
    Station street
    Nottingham
    NG2 3HX

    Does anyone know which is the correct one to use?

    Also, I read that Capital One do not charge the £10 for this, is this true or should I just include the £10 anyway?

    Thanks a lot for any help.
