has anyone won with capital one they seem to ignore the charges0

Everyone wins with Capital One if they goto the FOS or court. Full amount + interest is paid. If you goto the FOS first, you dont even need to list the charges - they will make Capital One do the work. Oh, and its free, but takes about 6 months. Court is quicker (just over a month), but you need to work out the full amount and interest, and pay court costs (these will be paid back by Capital One).0

So my question is should i take them to court to reclaim the full amount or go for settlement?
Personally i feel that this is a tactic of theirs in order to put people of going to court but i would be interested to hear other peoples views.

capital one paid up when i started the mcol (moneyclaimonline) process. this seems to be their standard proceedure.
Borgbaiterclaimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£54820 -

i have just received a offer of less than 25%
So can i just go directly to MCOL, or do i have to go to the FOS first, or can i do both ?
What should i do about informing cap one?
I was going to answer their letter with acceptance of the amount with gratitude, but that i will also be seeking the difference of the amount i want through either/both the FOS/MCOL
Is this right ????

I'm not sure you can take it as part payment unless your acceptance form is different to mine. It states at the bottom of my acceptance letter that if i agree to the refund this will put an end to the claim and no further payments will be made (or words to that effect)
As far as i know you can go to the FOS and if you are not happy with the result then complete MCOL. If you want a quick result go to down the path of MCOL first as the FOS can take between 6 and 9 months

I read on here somewhere that you should accept the payment "without grievence", which i think safeguards the amount they have offered you,
I will be writing this up in my own letter as opposed to their form.
