This is my first post so I'll try and keep it brief and to the point. I've got a Capital One credit card and I've had it for quite a few years (possibly 6 or more). I got it when I was a student and as you can imagine I incurred alot of charges. Unfortunately I'm still getting charges as I've never managed to get of the red zone with them as they constantly add more charges on. Basically all I ever do is pay the charges and my balance which has now gone way over my limit never goes down. I know I got myself in this mess and can only afford to pay a small amount every month but they're not being helpfull at all. I feel quite intimidated by the whole reclaiming process and I've read all there is to read about reclaiming but I'm still too scared to do it! I guess what I'm really looking for is the reassurance that reclaiming is the right thing to do.Do what you want because in the end people will judge you anyway.0

I am being charged 2 lots of £12 each month plus other fee's, which amount to almost £35 a month in charges, so Im going to reclaim mine back.
But I am in default with them for £592. Should I pay off the amount then start claiming bak? Or should I start it anyway?
The account is open but in default.

Capital one was the easiest of the credit cards. I wrote a letter, they offered a small amount, i refused and filed at court, which caused them to offer the full amount and interest.
If you don't need the money in a rush, you can even go the financial ombudsman route for free (still write to cap one first). That way you don't even need to know the charges total. Capital One have to work it all out.0 -

Start now, but any money refunded will pay off the default first, and then any excess will be returned to yourself.
You say defaullt - do you meen overlimit, or have you had a default put on your credit file? If so, this is a great chance to get it off. Insist on it as part of the settlement, saying it was caused by the unlawful charges.0 -

Its £92 over the limit, and according to my credit file it says 'in arrears'. Apologies I thought it was default.
No probs, just wanted to make sure you took advantage if it was.
But get a letter off straight away asking for your charges back and 8% interest.
You will pay off your arrears, helping your credit rating, and get cash in the bank if your charges have been high.0 -

Dont feel intimidated at all, use all Martins templates, you never need to speak to anyone so there is nothing to be scared of. Write first asking for a list of all your charges then use the template to ask for them all back, they will make an offer, which wont be what you want so refuse it. Then write to the financial ombudsman with copies of your letters and their reply and claim for the amount and add on interest which you can also work out from this website, then you should get the whole amount.
My charges were just over £600 and they offered me £200 which I refused. I wrote to the ombudsman asking for £867 which was the charges plus interest and got a letter this week to say Capital 1 will pay the whole amount and a cheque will follow.0 -
Ive read through all the posts and the on the first few pages quite a few people say they have phoned up and got the statements free, has anyone done this recently or are they charging £10?

Just to let you know I have just phoned the free phone number and they are sending me all my statemnts for free, so phone them before you send a cheque, it might be a waste of £10! I phoned 08009525150 They said it would take about 10 working days

Hi all,
just wondered if anyone could give me some advice i am trying to reclaim my credit card charges from egg and capital 1. First letters were sent on the 30th april along with a ten pound cheque asking for six years worth of statements. EGG responded by sending me all requested statements which i received on the 9th may, i duly responded by sending a letter on the 13th may asking for a refund of all charges, Have not yet heard back regarding this.
Capital 1 on the other hand are completely different, i have not heard anything from them at all. I on a repayment plan at the moment which is charging me a whopping 46.6 % :mad: per month, have not even touched the actual account since i began paying them back in june last year my outstanding balance is 1027.67 an my repayments are 30.79 per month:eek: .
However i digress, CAPITAL 1 are denying that i have an account with them and will not speak to me i tried to register on their site to make additional payments but it wouldnt let me. Any advice gratefully receivedMBNA 0% ends 10/04/2020 £15843

Dont know if this is helpful or not but with regards to capital one I phoned them up the other day on the free phone number and they are sending out all my old statements and are not charging me.0
