    In whose name is the claim? As a third party Roxburghe's can't actually bring a claim.

    Good luck. I am pleased you know the law, because on the rare occasion the filth has won its case vs the victim, there has always been an element of the judge not being sufficiently versed in Contract and Property Law. Indeed some Courts of Appeal have themselves discarded existing protocols.

    A real judge should have dismissed the case without a hearing being set. It may be that he wishes to throw the book at Roxburghe but you MUST make absolutely sure you read the laws out loud to the judge so he himself knows that he may be missing something. I don't think judges like that cabbage Thompson over a clamping issue are biased, just thick.

    If the judge hints at Roxburghe's amount to be "losses", make sure you raise the issue of how it came to reach that figure, and how that same figure would have been obtained has the alleged incident not happened.
  • In your defence, remember to ask the question:
    "please tell me, is this a loss or a penalty"...
    they may dither or try to circumvent but the bottom line is that it can be one or the other, there is no logical "in-between". If they fail to state the word "loss" then use the word "penalty" with the official language of sanction for the remainder of the hearing regardless whom you address.

    Remember that a contract is invalid if drafted in advance and in the absense of all parties negotiating in the terms.

    I know of Steve Dargonne, he used to be a Bank Assistant Manager (aka pen-pusher) in Worthing, West Sussex and is a bit like Ricky Gervaise in The Office. :p

    You really should take this to pepipoo and ask for a regular poster there to help with your case. There are LOTS of points of defence, not just who was driving, please don't go it alone.

  • We cannot say too much about the impending legal action, as those knob heads do read these forums.

    Spot on, don't needlessly give them ammunition. Accordingly, you'll find none of the reputable users will ask anything personal. But anything you are remotely in the slightest doubt about, just ask, both here and on Pipipoo so you can get the full range of replies.
