Wondered if anyone could answer my question

Am wanting to file MCOL today against Halifax credit cards - I am claiming against 3 cards - 2 which are closed - but not sure whether to put the claim on as one amount and 3 account numbers or 3 separate claims - which would mean that I have to pay MCOL 3 times.

Does anyone know what I should do?

    Thanks

You can put them all together but before you do, have a think about where you would want any monies reclaimed to go as they are likely to put it into the accounts claimed from so work out which account would be best to put as the "lead account".

edited to add, I should read more carefully, 2 are closed. If the 2 closed accounts still have "debt" on them for any reason they may well put the monies into those accounts.
  • Last week I started the court process against my bank as I didn't hear from them and today is the day that the court considers the papers served. However this morning I had a letter from the bank offered me £100 less than my claim of £700. I'm tempted to accept this offer for speed but what happens to the £80 I paid to start the court process? Do I lose that £80 or do I have to take it all the way to get my £80 back. From the looks of the letter (which doesn't have a date on it) it's possible that the letter was sent before they got the court papers
  • Hi there,

I am extremely new to this forum. I have been following Martin's template for recovering bank charges. I sent my second letter to LTSB asking them to reply withing 14 days, they replied in 15 days and on the 15th day (before I received their response) I put in a court claim... LTSB have offered me 1/3 of what I am claiming. Is there a template response or anything I must leagally say in response? I guess I reply to them and cc the county court that I will take their offer as part payment only towards the full amount. I have noticed they have deposited the monies into my account. Where do I stand legally if I use any of this money they have deposited?

A quick response/advice would be greatly appreciated

    Regards,

    M

  • It seems Halifax are really trying to make reclaiming charges as difficult as possible.
I managed to get my bank charges back really easily, they didn't even write with an offer, they just called, made me an offer, I refused but suggested a higher offer (I was only owed less than £300 in total though) and they agreed. It was in my bank account within the week.
My credit card though isn't going so well. I wrote to them asking for my money back (less than £800 including interest) and they have sent me a letter saying it clearly states in HBOS terms and conditions that charges are applicable in these circumstances (late payments only) and therefore I will not be receiving a refund! So it seems I'm onto round 3!
My friend though is unable to obtain copies of statements. She wrote to them, gave them 40days, when it had passed she gave them a call and was told they had lost the documents she had sent. When she asked for them verbally was told it would cost her £100!!!!!
I have advised her to call again quoting Freedom of Information act as they haven't even refused her in writing.

Any other suggestions for either of us????
  • Hi, I was just wondering if "14 days" we state in our letters to the banks is working days or including weekends and Bank Holidays?

It makes a big difference, plus, if you start court action, then receive a letter from the bank, you may lose your court fee (£80 or £120).

I can see from some of the comments above that this may have happened to a few people.

    What's the deal?

    Richard (claiming £1500 from HSBC)
  • As you know we are claiming money from HSBC and they have now put a defense in agiainst our claim. BUT their solictors have requested details of the charges which were already supplied to HSBC. We sent these details in and have tried to contact the solictors on several occassions but they are ignoring us. What do we do as they slowing things by pretending we don't exist???
  • Hi,

Firstly, I would like to say thanks for all the information from everybody on here as it has been a great help :T - I am a 21 year old single parent, who, to be fair, has been a little stupid with money in my teens. Reclaiming all these bank charges is going to make a huge difference to me and my daughter so thank you again :j .

I was just wondering whether anyone has successfully reclaimed charges on Credit Cards/Store Cards and/or Loans???????????????

Finally, I have a loan outstanding for £1,600 which good ol' Natwest offered me when I was 17 to clear my £1,500 overdraft which I also got at 17 - They made out like it was my only option and that they were really doing me a favour and getting me out of a deep hole so in my naivity I said 'YES!' - I then went through a rough patch, lost my job and tried to claim on the PPI that they had sold to me as the best thing since sliced bread - I was told that I wasn't eligible to claim! So in the the end I had default after default, charge after charge and they ended up sending my debt to debt collectors  . Unfortunately, I haven't helped by just ignoring the letters that keep coming but I really now want to get this sorted! I have finally got sensible with money, am able to put a little away each week for my daughter and live happily but want rid of the 'RED LETTERS'. Any advice would be appreciated as I remember being told once that I could have the whole thing written off due to my age but not sure how to go about it?????

    Cheers in advance
