AQ dispensed/proceedings transferred

I am absolutely lost now, having read on through the documents i got today, there is a cover letter from the northampton court reffering it to my local nelson court, saying that....1. the filing of an allocation questionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise.
note any party affected by this order may under rule 3.3(5) apply to have it set aside, varied or stayed. Such a party must apply under rule 23.3 within 14 days of service of this order.

In plain english what the hell are they on about please. or is it a job for my solicitor.

    My bank has said it will defend itself etc etc but rather than receiving an allocation questionnaire I have received a 'Notice of transfer of proceedings' with a judge ordering that 'the filling of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise'.

    As well have this I have received my bank's (Lloyds TSB) defence.

    Does anyone know what this means and what I should do next?

    Barclays bank have filed a defence against me. In it they say that the charges are reasonable, but also that my claim does not provide details of the account in question or the precise date or amounts of the unlawful charges. Is it too late for me to provide this info to the Court now? Or have I mucked the claim up?!

    Also, the Court has dispensed with the allocation questionnaire! So how do i go about asking for standard disclosure from the bank?

    I'm getting scared now - please help!

  • Don't worry - you have a right to reply to the Defence (but only one reply, so make sure it contains all the info Barclays have asked for).

    thank you! Do i just send further particulars of claim to the court and the bank? Should I also ask for standard disclosure in the further particulars?

    I am in same place and time has you,with myaction with my bank They have put a defence in,and i have also had my claim transferd to another court,same questionnaire dispensed for this case,So am very interested with were to go orwhat to do now ,do i contact court or just wait for them to contact me

    Exactly the same situation as me. The same documents, and I also haven't yet been sent an allocation questionnaire either.

    I'm confused. And a bit scared....

    Hi!
    I have been away on holiday and whilst away, the 28 days expired for Barclays to file their defence to my claim.
    I just checked onl MCOL, and it says that they filed a defence on 01/03/07. This date isn't right as I only filed the case online 28 days ago!!!
    Am I right in thinking that I will now be sent the necessary AQ form from the court, and can expect a court date through next???
    I am a little confused by it all now ... !
    Any advice greatly received!

  • I have gone through the stages to reclaim bank charges. The bank has filed a defence and quite lenghty to. The claim was being processed through the Northampton CC. The court letter states that allocation questionnaire be dispensed with unless the distrcit judge at the court of transfer orders others wise. I do not have a questionnaire to fill in. Has anybody else had the same response? If so, what course of action did you take? I do not know what to do next!
