    I was wondering if someone can give me some advice. I have been viewing this website for many weeks and always took encouragement from it. I had obtained my statements from my bank (LLoyds TSB) by the end of Jan 07. The bank charges totalled £740.00. I first wrote to them on the 15 Jan 07 requesting a refund of only £740.00. I had no response. I then wrote a second letter on the 28 Feb 07 and the 1st Mar 07. I had no response.

    I then issued a legal proceedings via MCOL on the 8 Mar 07. I was claiming £1048.63 (bank charges + interest + legal fees). They acknowledged proceedings two days before the deadline and stated that they were going to defend all of the claim. They subsequently sent a Defence through some solicitors in Brighton. The claim was then transferred to my local court without the need for an allocation questionnaire, and gave 14 days to apply if either party wanted challenge this. I opted not to do anything.

    Today, I have just received a letter from my court advising that the matter is to be transferred to the Mercantile Court, Admiralty Court and Commercial Registry at the Royal Courts of Justice!! I am a bit taking aback by this. This matter is not complex enough to warrant this. I don't have money to instruct any solicitor or barrister to take this case on. I am now considering withdrawing the proceedings. Any advice would be much appreciated!! :confused::confused:

    Yes you can add recent charges and interest right up to the day you file court claim. Good luck :)

    Hi....and thanks to all the moderators who are providing excellent help and advice. Excellent site giving excellent information. WELL DONE and keep it up.

    Wanted to ask the following
    I am just about to send off my £10.00 for the following....

    NATWEST - 1 Joint 1 Personal Account
    NATWEST - Business Account - (was director of company)
    (ONLY sending 1 cheque to the natwest)
    Halifax - Joint Acount
    American Express - Credit Card

    Q. Can i claim a third of the charges back from the Natwest Business account, (3directors), as this business account, meant i had to keep dipping into personal accounts, which meant they were being charged as well. In the end, i had to arrange a settlement figure with the Natwest for all 3 accounts.

    Reason i mention this. Didnt someone yesterday win their money back from NATWEST £36k.....for the business account?

    Keep you updated with this...as this could amount to a large'ish repayment (if i am succesful)

    If there is no explanation as to why I would ring the court to find out what is going on. It may be that the local court is so busy with these type of claims and so they are being heard elsewhere thats all. :confused:

    Yes you can claim back charges on a business account but the names of said charges are different that you can claim for. This thread should help you further with this type of claim:

    Thank you very much for that. I have spoken to my local court and they have pretty much confirmed that this is a blanket policy they have for all claims of this nature. I have spoken to the RCJ and said that I wanted to have the matter transferred back to my local court or a mutually convenient court. They have said that I should put in a letter and they will pass it on the the Specialist judge to decide.

    Which leaves me with the question... should I have the matter heard at my local court or with a specialist judge at the High Court? :confused:

    Wondered if anyone could answer my question

    Am wanting to file MCOL today against Halifax credit cards - I am claiming against 3 cards - 2 which are closed - but not sure whether to put the claim on as one amount and 3 account numbers or 3 separate claims - which would mean that I have to pay MCOL 3 times.

    Does anyone know what I should do?

    I have just checked my account with abbey on the internet and have been charged £115.00 today.
    1 unauthorised overdraft for £20.00 and 3 for clearing Direct Debits at £30.00 each. (each direct debit was cleared and then uncleared the next day, which still left me with the money to find to pay for these).
    I have now gone overdrawn again because they have taken this £115.00 out of my account and another 3 direct debits have not been cleared because of this.

    Am definately looking into closing the account but does anyone know which is the best bank to go with.

    I have only been with the abbey for 7 months and was definately a BAD DECISION.

    Please Help.......

    First off grate site, very useful.

    Im currently in the process of claiming back my bank charges following your "plan" and just wanted some advice really,

    Its been going on now quite some time and the have filed a defencefor the full amout im claiming(£1654)

    and the lastest letter a recieved from them is a "notice of transfer of proceedings" from northamton court to my local court in eastbourne.

    So what i wanted to know really is

    1 is there a reply i need to send?

    2 weather this is normal?

    £ and westher im actually going to have take this to court?

    any advise/help on this would be gratelyy apprechated
