okay so ive been ignoring Highview letters for the overstay fine at the almondvale shopping centre, whichhave been sent.
But now I have a letter from debt recovery plus ltd , saying to pay up within 7 days, saying breach of the agreed t&c regarding parking ontheir clients private land...As payment not been received our client has instructed us to recover the above monies fro you as the driver at the time the vehicle was parked.
Private land ???its a car park
Says accordingly if we do not receive full payment or conatc from you with your proposal for payment, this matter may be passed to our solicitors to commence county court proceedings.
Do we have county courts in scotland?
okay so what do i do?????
none of the letters were sent by recorded delivery or beensigned for etc, all by normal post .....so no evidence that the letters were every received ....
Please convince me not to contact company to say didnt get any letters etc and appeal0 -
Yep if they can't even get right the legal system in Scotland , it just underlines the fact they never do take anyone to court whether its the small claims or sheriff. The advice is to ignore the scammers, I believe the next one will be zenith who are in fact dr+ pretending to be someone else.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Others more learned and experienced here will soon tell you to keep on ignoring. The 'correspondence' you are getting should be a cause of merriment not worry! Continue to ignore, they will not take you to court. Bin their worthless threats because they are worthless and only fit for the bin. But do keep us updated with the highly likely outcome they eventually give up with you and move onto a mug who will pay/cave in...which you are not and will not.Got a ticket from ParkingEye? Of course car parks are 'private land' (as opposed to public/Council Highway). Doesn't mean you were not already allowed to park there of course.
Why would you not have been expecting this well-known next letter in the chain, when we have a sticky thread with pics of typical PPC letters? OK, it seems that no-one has bothered to upload pics of the specific debt collector letters that Highview use - but that's only because they are the same as the usual suspects.
It's always worth checking the other PPCs listed and finding 'your' letter chain there instead (your letter will be there, I guarantee it will only take you about 1 or 2 minutes to find it):

Once you've found your letter chain you can see what will come next, and which one is the last letter. You'll miss them when they stop, I do!! Just play snap with each letter, I am really not sure why you are so worried. It's only a junk mail scam, won't actually go to Court (they lie).PRIVATE 'PCN'? Just another reason why they won't take you to Court...because there are several CCJ summonses unpaid BY THEM!
They appear to be "faceless" but you can find out who HighView Parking are by going to Companies House. Don't believe their idle scamming threats...all non-enforceable in Law!0 -
My elderly mother just got one of these charge notice from Highview Parking after her car was pictured at Livingston Almondvale Retail Park. She wasn't even the driver!
I see that the "Protection of Freedoms act 2012" only applies to England and Wales. Anyone any further on the position north of the border?
I don't want her to be paying or worrying about it. Has anyone been further down the line in ignoring Highview's tickets (at Livingston) and been successful at having matters dropped!

Yes. Did you actually read this thread - its all spelled out quite clearly already.
Getting it dropped! You are kidding, right? These jokers seldom give up if you are the kind of mug who takes them seriously. Its a scam and the best way to deal with scammers is not to engage them from the outset.
So ignore everything they and their fake collectors send to scare you. As you see from above, most PPCs don't even know or care that we have a different legal system, so their threats are doubly meaningless!0 -

Simple. You tell them that you were the driver so that you get all the threatograms and can ignore them. The pics of all letters are shown in the 'PPC letter chains' thread - not necessarily listed under Highview, please look at the other PPCs' listings as they use the same debt collectors. See the 5th thread down on this parking forum and look at the OLD letters pre-October as we don't have a full thread of new ones yet. All PPCs use the same letters.
Was this for an alleged overstay and was she a passenger at the time? If she is elderly then she's covered by the Equality Act 2010 (which also covers all chronic conditions even if she doesn't have a Blue Badge).
An alleged overstay against someone (driver or passenger) who is protected disabled or elderly is unlawful:

That BBC article mentions the DDA but it's now the Equality Act and AGEISM is also covered so she's protected.
The only difference in Scotland is that you don't have POPLA - so what! - but you do have the Equality Act (I think the only place that the Ageism section of that law doesn't apply to, is NI).
All you need to do is write/email Highview and Tesco as well, complaining (if she or anyone in the car was elderly or disabled). Point out that you were driving so they need to deal with you - but that you expect the PCN to be cancelled due to the Equality Act breach and you require to be told what 'reasonable adjustment' Tesco and Highview are making for their elderly or disabled customers, as the current arbitrary time limit for all is breaking the law across the whole of Britain. Point out that Asda are starting to keep a list of 'exempt' car reg numbers where the regular customer is disabled or elderly - so what are Tesco doing about this serious breach? Enclose a copy of the BBC article and point out they knew about this years ago.
If it wasn't for an overstay then still complain to Tesco and Highview about the whole scam of trying to extort extra money from their paying customers for any old reason, pretending they can fine people doesn't help Tesco's shaky reputation, etc. Give your address as driver so then you'll get the letters.

Thanks for your response. I may just write to High View to say my mother was not the driver and there is no obligation on her to disclose who was using her car and ask that they direct any correspondence to me to save her getting hassled.
The equality stuff is interesting. I hope I didn't mislead you into doing all that typing.
My reference to my mother being elderly was simply to highlight that this is (i) a lot of money to be demanded of her, as a pensioner with little income - what, it adds up to £115 if not paid within 28 days including an admin fee! (ii) this poor lady should not be having to worry about such things! I'm out of the country for the next month so can't monitor things and I know if she gets a reminder she will feel obliged to pay it just to get closure on it if i'm not around to intercept.
She does not have a blue badge and is still fit and mobile enough to get around independently, although even the car park was actually quite a trek away from the centre.
Maybe, as you suggest, I should just say that I was the driver so they have a new target to harrass...
Oh, and it wasn't at Tesco's - just a retail park car park - so who actually owns it I don't know!
