Hi folks, also recieved one of these parking charges from Highview parking for parking in the Currys/Argos Etc retail park in Livingston and was absolutely outraged when I read it especially as I realised by the time I had recieved it I'd since parked in the same car park and overstayed the 2 hour limit again ! so I'll have another one on its way but after reading the great advice from so many well informed people on this site I've made up my mind I WILL NOT BE PAYING THESE OUTRAGEOUS DEMANDS FOR MY HARD EARNED MONEY. I have lived in this area all my life and as far as I was aware this has always been a free car park, I certainly didnt see any clearly and prominently displayed signs stating the maximum stay was 2 hours and the fact that I and many others it would seem have overstayed our welcome in this car park I think proves that the aforementioned signs are NOT clearly displayed otherwise we would all have seen them wouldnt we ! Whoever is responsible for allowing this bunch of greedy money grabbers to set up there spy cameras in the car park should be ashamed of themselves and wheather it is anything to do with the shops in the retail park or not they are going to loose customers through it because I for one will never ever park on there !!!!!! piece of tarmac again and Im sure other decent law abiding citizens will do the same after being made to feel like a criminal when all they were doing was going for a bit of shopping and find themselves being preyed on by this bunch of vermin. If the scum who run Highview Parking want money why dont they try going out and doing an honest days work for it like the rest of us have to instead of trying to con other peoples money off them. As the old saying goes "At least !!!!!! Turpin wore a mask" this is pure and simple DAYLIGHT ROBBERY. I for one will never pay up.0

Totally agree and totally understand your anger.
Now copy and paste that tirade into an email or letter and send it to the CEO of Argos and Currys, etc., and also the Managing Agent of the retail park. Google the name of the retail park and you should find a newspaper article or summat whih tells you who runs it, they will be the one responsible for these scammers having been let loose there in the false name of 'parking management' (no such thing for a profit-making firm).
And maybe copy to your local newspaper as well to spread the word that these are fake fines and no-one has to pay them and everyone should complain & vote with their feet/wheels.
P.S. maybe change some of the language a little bit...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I couldn't do that when I go to the football as it would jeopardise the club's position with the consent for BHA's new stadium - we have to use Park and Ride round here in Brighton, or train/bus/Shanks' pony...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've just received one of these from the same car park in Livingston too.
A late update.
Letter sent:Dear Sir or Madam,
Charge Notice Ref number: xxxxxxxxxxxxx
Vehicle registration number: xxxxxxx
You have recently written to me alleging that the above car was parked at your clients property (Almondvale Retail Park) on xxxxxx between the hours of xxxxx and xxxxxx (duration xxxxx). I believe that your claim for payment is incorrectly issued and I will not be paying your demand for payment for the following reason:
• The alleged contravention did not occur
Quite simply, there is a flaw in your automated system and I was not parked inappropriately at the time the ticket was issued. This is due to the fact that the car was parked elsewhere for the majority of the alleged offence. I would like to take the opportunity to point out that two short visits were made to the aforementioned car park, one before work and one after.
I find it hard to believe that your automated system cannot cope with a scenario where a vehicle visits a car park on more than one occasion per day. I trust that you will be able to review your 'evidence' and will find that your claims for payment have been made in error.
If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter.

Within a few days I received a reply stating that they had reviewed the matter and that they would no longer be pursuing payment.
/edit - I should point out (for those who haven't read the whole thread), that my car was parked elsewhere for the majority of the duration they were claiming. I'm not suggesting that this exact letter would work for everyone, but any similar letter disputing their claims, should get them off your back, providing you follow the advice given in the template letter guide on this forum.0 -

Hi Folks, you may recall, my Dad's lease, driver, Me.,
Calls to Leasing company, letters to Highview, Lease company and manager at PC World, Livi
Highview replied-summary=signage compliant, notice issued correctly, reduce to £50 if pd in 14 days. I'm happy to ignore them but...
Leasing company replied-summary=If appeal is successful, will be able to credit admin fee charged to Dad's account.
Parking companies not governed by statutory law but are under Civil Law, trespassing or contractual breach.
Quotes re. trespass law, owner entitled to receive reasonable compensation or damages(fines)
Quotes re. Contractual Breach, Implied acceptance if driving into car park. Contract then formed and can be breached.
Providing appropriate and clear signage was about the car park, we have to treat this fine legitimately.
On a final note, we treat parking issued notices with the same integrity as fines issued by councils.
Where do I go with this one, I am happy to ignore highview now they have my name and not my Dad's but can I expect to convince the leasing company to drop their admin fee or should I pay it so my Dad doesn't need to.0 -
Look at the T&Cs of lease, if they don't have a fee to cover this then they are in breach of it. These are not fines or penalties. I would go along the route of letter before action demanding payment or there will be a claim going in to refund the payment taken.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
