    i posted on another thread before seeing this.
    I need to contact Highview re. notice issued after parking at Livingston 20th December as the sent the charge notice to my Dad's leasing company and I need to get them to divert from that company and write to me instead?

    You do because the lease company are the danger here, they may just pay it, and/or they may try charging an (unjustified) admin fee for each and every letter!

    So write a simple appeal in your name as if you were driving (no need to actually lie if you weren't actually driving and in fact it's best not to say).

    So word it in the third person like 'I am very angry about receiving this 'ticket' when the car was parked {just before Christmas in a busy retail park with queues at the till/in a free residents' car park with the authority of a resident/or insert other appropriate reason for it being parked but without saying 'me or I'}. On what basis do you think you can dress up an obvious unlawful penalty as if it's some sort of agreed fee, when it certainly was not agreed or fair? I deny any contract with your company so I suggest you stop wasting my time and cancel the ticket forthwith.'

    If it was a retailer (at Christmas!) then it's inexcusable - so copy them in as well or go instore brandishing your receipt & the fake PCN & speak to a Manager, making it clear this will be the difference between you shopping there again as a family, or not.

    I received a PCN for overstaying 2 hour limit at the free car park at Almondvale in the lead up to Christmas.

    There was a half hour queue just for the cash machines. The shops were really, really busy.

    I appealled on the grounds of inadequate signage and this has been refused.

    There is no one else to appeal to and I am anxious that I will be taken to court

    Has anyone actually ever been taken to the civil court and pursued successfully?

    I will never visit Almondvale centre again.

    Yes people have been taken to court, but not from this company so just ignore them and stop communicating with them.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Stop being anxious and start being angry. Complain to the Store Manager in person, or the Retail Park Manager if there are several stores, and say that you will NEVER visit Almondvale again unless this is cancelled. If it's easier, write a strong complaint letter or strong email instead but not a phone call (doesn't have the same effect as a complaint in person or in writing, much easier to fob you off and for you to start saying 'oh, right, OK' when it is NOT OK!!).

    How dare they not extend the parking time at Christmas?

    But honestly, get real about the rubbishy 'ticket'. Most PPCs don't even know the first thing about a small claim and have never ever tried one. It's all about sending victims of the scam, a chain of 'scary' (NOT!!) debt collector letters. And for you, ignoring them is as easy as just deleting phishing emails. You do not even have a real parking ticket, it's just a piece of rubbish. Like all the other posters on this board, you have a fake PCN.

    The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

    The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

    There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all.

    Tick off the letters here.

    Just play snap with the threatograms from debt collectors - simply choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority.

    My friend appealed to this mob and, not surprisingly, it was rejected.

    He now knows the way forward and why he should ignore future attempts to extract his money. The only problem is that he posted the cheque last night.

    My question to Coupon-mad, Alexis etc is: What should he say to the bank tomorrow morning when he tells them to stop the cheque? I thought that something like" I have been made aware since sending the cheque that I do not legally owe this amount and that I need it to be cancelled"

    Also, should he phone/e-mail and tell them it's been stopped and offer to pay any actual parking fee that should have been paid (it was Livingston)? Please note, I don't care about any inconvenience I cause them, I just want to occupy the moral high-ground.

    Grateful for a reply from the respected posters. (No oinkers or hasbeens please!)

    Quick edit: Despite being in Scotland it mentions POPLA. Sadly, it does state that POPLA only applies in England and Wales. Drat, I thought I had them for a minute!

    Just tell them the cheque number etc
    Thst you wish the cheque to be canceled and it will be for a fee of around £8. Then write a letter along lines of cheque has been canceled due to your company not being legally entitled to funds.

    Nothing else. You don't need to say wht u want ut canceling etc
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    If he says the cheque was written out but then he lost it(!) then it may well be free to cancel it. If not then there will be a fee but it's worth it.
