    I've just received one of these from the same car park in Livingston too.

    Funny thing is, I visited once before work (approx 10 minutes) and once after work (approx 40 minutes) but they're trying to claim for the full 9hrs.

    I already knew that the fines weren't enforceable, but I am contemplating one reply to point out the glaring flaw in their system. Then just ignoring any further correspondence.

    If Highview parking insist on chasing me, after I inform them of their flawed system, then I will be writing to each of the retailers on the site informing them of the problem. Can't imagine that they'll be too happy with this company chasing away genuine customers.
  • Fair plan. Unfortunately, should they reject your "appeal", you won't be able to put them to further expense by appealing to POPLA, as it's Scotland.

    They know full well about the way the ANPR works ( original software was used for checking staff in and out times to make sure they did 8 hours etc so they only needed the first in/last out times), they rely on the normal british public seeing the ticket, thinking they must be right and just paying.

    If you want to cause them grief then get recorded times of you in and out and expose them on the local rag.

    Yeah, as peter says, its not a flaw. They do it deliberately. They earn more money that way.

    Oh no, hang on, they're there to manage parking, not make money. Silly me.

    I know they're aware of the 'flaw' (perhaps I should have written it in inverted commas initially).

    My point was just that if they choose to try and pursue the claim, even after pointing out the 'flaw', then this would be of more concern to the retailers.

    Christmas is coming up and there's a fair chance that people will visit a car park more than once. If the retailers know that this company is making no attempt to distinguish between one long visit and multiple short ones, then I would imagine they'll not be particularly pleased.

    Livingston's retail business is very reliant on people choosing to travel there for the convenient (out of town) experience, rather than visiting near-by high streets in Edinburgh and Glasgow. If parking becomes a problem, then the attraction of Livingston is dramatically reduced.

    By all means draw it to the attention of the retailers, just pointing out its a bit of a waste of time drawing it to Highview's attention first.

    The only reason to draw it to Highview's attention would be to see whether they choose to acknowledge their 'mistake', or whether they choose to continue to harass a genuine shopper. (I think we all know what the likely answer there is).

    My assumption was that any future harassment from Highview would go further in showing the retailers how far these scam artists are prepared to go in terms of chasing away genuine customers. And also show the retailers that Highview are either incapable of (more strictly 'unwilling to') implement a system that means they correctly identify people who are 'abusing' the car park.

    Thanks. Not overly confident that it'll make any difference, but will see how it goes.

    Appreciate all the advice here. Been a long time lurker and it's always a good source of info.
