am i the only person here thinking that something isnt quite adding up?
OP. you said you can categorically proove the driver signed for it? if your evidence is so hard and undisputable, then why havnt you provided this to the DELIVERY COMPANY?
i personally, am sensing a troll thread, but i may be wrong...

especially considering this seems to be average rates, i very much doubt one would do it for free because they were so disgusted at the fake signature

I have said all along I am awaiting the outcome of PayPal before I proceed with any other options0

Re the chargeback question, I still think- as per my original post on that question that a chargeback is not possible
Credit card companies don't just hand over money if someone says so, they will surely ask the seller (or paypal in this instance) whether delivery can be proved- seller/paypal says yes and chargeback fails. Am I mistakenn or is it really a case that any of us can use a card to buy an item, tell the card company we want our money back and they just say 'fine here it is?'
As for the contract with the courier company, again as has been covered in the thread, yes it is the seller that has the contract, but since seller believes his side of contract has been fulfilled and is perhaps unwilling to help further the buyer has no option but to persue the courier company themselves- a contract is not needed for that.
I think it depends, a friend of mine fell for one of those credit check thingys where they sign you up monthly and although they didn't want to VISA refunded the money.
There have been threads on the eBay boards where a chargeback has been fought by the seller, the buyer does it again and the seller loses.
But as I said above, even if the card company refunds, the money should come from Paypal and in their view they obviously have enough evidence to suggest the claim is invalid (otherwise, lets face it, they wouldn't be protecting the seller) so do Paypal write this off or ask the buyer for it back? Does the buyer get to keep their Paypal account after, in this case, costing Paypal £150?
If the signature was on a PDA I don't think handwriting would come into much as it's difficult to write normally on those and it's not like signing your passport, I just put a meaningless squiggle on any PDA. Unless there was constant deliveries and one signing was different from all the rest it might be very hard to prove that it wasn't the addressee who signed.
Me personally, for £150, I'd be at the depot speaking to the manager and would want to know the outcome of the interview with the driver and what the depot were going to do.
I can understand the OP's frustration and this is one of the big downsides to online shipping as the evidence is stacked against them but on the other hand it's not unusual for a parcel to be delivered somewhere else.
It also raises another interesting point, if the retailer says the parcel may be left in a safe place, it is but is then stolen, who is responsible?
Retailer has delivered to the address, courier has delivered as per the terms and unless the place left was clearly negligent who is to blame?
If left in a porch and some random person delivering leaflets opens the porch and takes the parcel who loses out?In the game of chess you can never let your adversary see your pieces0 -
or, what if, delivery company deliver at the same time an edfsalesman is at your door, can he sign for it as he is at your door? we all know how robbing edf are lol0

But then they would not have a signature, and thus no POD.
There doesn't necessarily need to be a signature, Royal Mail tracked for example has proof of delivery but no signature.
One regular courier leaves parcels in a neighbours porch with no signature on the rare occasion I'm not here but as far as the courier are concerned, that's it, it's been delivered within the terms agreed by the client and the client (retailer) would be told the this by the courier.
In terms of eBay/Paypal a signature is only required for £150+.In the game of chess you can never let your adversary see your pieces0 -

When I sell on ebay I specify the cheapest signed for delivery, and that's what I ask for when I go to the post office.
Be careful with that as you are likely to get recorded which is not a suitable service for most items.
You must know in advance what service you want to use, RM basically only do two, recorded or special- although there are often various parcelforce ones available as well. Don't rely on the PO to give you the right one.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
