Delivery Company say I signed I was not home
Comments

Sounds from the #74 post that the delivery driver has been 'confused'.0

It's fortunate you don't care about the money as you appear to have approached it in such a way that it will end up costing you more.
As has been said a graphologist can prove that you didn't sign it but can't prove that no one at your address or pretending to be at your address signed for it. Can you prove that you are the only person who has been in your premises or even outside the door within the time the parcel was supposed to have been delivered?
If you do end up in court, the judge may ask you if you contacted the courier direct and if not, why not. You may be right, but then, if the seller was on here, I may be saying that to him too. You seriously need to check if the seller is the person at fault and culpable.
Like I have already said at the moment I have to go through PayPal - if they find against me and that point I will go forward to the Delivery Company but by pressuring the seller I may get somewhere anyway0 -

As I said at post number 2 (which if read, could have avoided all the carp in between). You will lose a dispute.
Your first appeal should be a card chargeback.
Perhaps in the meantime you need a reality check? There is no need to be rude or personal to other posters.0 -

If you read that persons first comment to me and then pass judgement on who was being rude or personal
So far everyone has put their opinion positive or negative and in this thread which is 4 pages long - I have not said anything to anyone which can be construed as rude until I was provoked0 -
Lets just say - if it gets as far as court and the driver is there - if he continues to claim he never signed - there can be categoric proof brought forward to prove it was him - remember he will be under oath - will he be prepared to perjure himselfif they find against me and that point I will go forward to the Delivery Company but by pressuring the seller I may get somewhere anyway0

You said you were going to send notification of court action to the seller so the delivery driver won't be there (unless the seller and courier are the same company).
Now that does make sense (although you will lose the Paypal dispute because the seller has tracking).
I have read cases where PayPal has asked for evidence of the buyers signature and found in their favour - in this case that may or may not happen0 -
Interesting! I've never heard that myself - any links at all?
It was amongst the dozens of searches I performed on this subject - I never kept the link
The gist of it was - a similar case - and PayPal asked the lady in question for her driving licence to see her official signature and subsequently found in her favour0 -

I have never ever come across thAt before and can find nothing at all to that effect doing searches.
I am surprised though as PayPal have no way of knowing who is who and never intervene physically with disputes and Ll their online t and cs suggest that intervening in this way would breach their rules.
