Delivery Company say I signed I was not home

I ordered an expensive item - Samsonite Suitcase - at this stage I will not mention the retailer - cost £210 (reduced from £244 on every other site)

I completed the transaction via PayPal on their own site

The delivery never came on time so I left it a few days and then contacted the retailer - they subsequently provided a POD with a signature in the Sign here box - a circle with a line next to it - NOT MY SIGNATURE!!

Also the time of the supposed delivery I was on the school run and there was no-one else home to sign

I told the retailer all of this and they launched an enquiry with the Delivery Company

Their response is below:

[FONT=&quot] I can now confirm from the investigation completed with our local depot, the driver and upon checking the drivers GPS location for the day in question it does [/FONT]
[FONT=&quot]place the driver in the correct location and can confirm the delivery was made and accepted by someone at the delivery address and the name on the proof of [/FONT]
[FONT=&quot]delivery is the name which was given to the driver. [/FONT]
[FONT=&quot]We also arranged for the driver to return to the address to double check if he did go to the correct address and we can confirm this.[/FONT]
[FONT=&quot]Regrettably we are unable to send him back anymore and all our checks have proved the driver has followed the correct delivery procedure. [/FONT]
[FONT=&quot] In view of our findings, please note we have closed this investigation.[/FONT]

The retailer has told me to contact the Delivery Company - I told them straight I have no contract with the delivery company and the driver is lying

I have opened up a dispute with PayPal

Is there anything else I should be doing?

    Did you fund the PayPal transaction by credit card?

    Have you checked the delivery address you (PayPal address) gave the company?

    Yes by Credit Card

    Why will I lose?

    Naturally my PayPal address for delivery is correct

    You will lose the Paypal dispute.

    To be fair, the vendor has gone out of their way to help and if you look at it from their point of view they have been given all the evidence from the courier to prove it has been delivered. The vendor is possibly even thinking that you are trying it on! It wouldn't be hard for someone to sign in a signature not of their own and then claim 'I didn't sign that' (I'm not suggesting this is what you have done).

    Your next step is to take it up with the courier company yourself - ask for all the evidence just in case vendor has made it up. After that then it will be a small claims. The vendor is protected with all that evidence so I would suggest the courier company as the target, although if the evidence can be proved in court then I guess you will lose.

    Presumably the company you ordered from not willing to do anything further to help? I don't know how accurate the GPS is (to the exact house, road etc) but in the last week two different couriers have made two mistakes with my deliveries. One went to a house adjacent to mine and with the second, I signed for two different myhermes parcels but only after the driver had left did I realise one was for a house several houses down the road. With the latter the driver input the name on the parcel whereas couriers like DHL usually ask for a surname before inputting it. In both cases I assume the GPS would show the driver was in the right area?

    As a signature is required for a paypal dispute over £150, the delivery company will be able to provide one. You may be able to ring paypal and offer to provide them with a copy of your signature from your passport, to show it's nothing like the one the delivery company has but I doubt they'd accept that as many peoples signatures on the signing machines are nothing like their own.

    Is there a road with a similar name close to yours? I would also go to the courier as your options are limited if the retailer won't help. I had a smilar situation to you last year and the retailer in my case overruled the courier and they sorted out a redelivery for me.

    GPS tracking is only accurate for between 3-15 metres 95% of the time, weather and time of day can be factors in how accurate it is, this gives plenty of scope for the driver to have gone to another address, if he has messed up he isn't likely to admit it to his boss.

    I would ask your immediate neighbours if they have taken in a package for you, they might not have gotten round to informing you for various reason, they may presume you have been carded and have been expecting a visit from you to collect it.

    If this does not prove to be the case then I would file a report with your local Police office of theft, I am willing to bet that the courier company will have a change of heart and back track on their story once the Police make enquiries.

    The police will almost certainly say that its a civil matter, particularly as there is tracking info.

    They probably will it is their default answer, but it isn't true and the OP shouldn't accept it if they say it is, tell them to go get clarification from the duty solicitor.

    I will not let this matter drop - it seems that this is a franchise business so the Parent Company will not get rid of drivers as they earn money out of them

    Even if I do not win the claim I will take it to the small claims court - would I be suing the Retailer or the Delivery Company?

    We had a delivery which didn't turn up. The company insisted they'd delievered it and it had been signed for. Funnily enough, it turned up left on the doorstep the day after we'd complained.
    Reason for edit? Can spell, can't type!

    If this does not prove to be the case then I would file a report with your local Police office of theft, I am willing to bet that the courier company will have a change of heart and back track on their story once the Police make enquiries.
    I would also contact the Police and Trading Standards who may help. The police have to be interested as theft could be a possibility, be it by someone at or near your property or by the delivery driver.

    As a seller it has happened a few times and all but one occasion the courier immediately backed down, I did have one where the customer filed a claim through Paypal and when I provided the tracking the buyer lost, I later sorted it out for them and got their money back.

    So if it was me I would pursue with the seller, the courier, police and Trading Standards.
