Socrates is/was still awaiting refund, which can only come from the seller. If the seller puts claim in for goods and the courier pay out, then there will still be a wait for the seller to pay out. Given their previous track record they may not bother with the claim, or if they do, not necessarily pay out. This case is not over until Socrates has money back for the lost goods, receiving apologies/admissions is nothing without the cash.
On the contrary, given the sellers track record of willing to investigate despite the tracking showing as delivered, hints that they will refund. They would be stupid to refund before the courier agrees to the claim! The ball is still in the couriers court, so to speak. As I said before, all this could have been done and dusted a long time ago!!

I bought something a while ago and the delivery man just handed it to me, I didn't sign for it, even though I could see it was supposed to be signed for. I looked online out of curiosity on the RM website and it had the signed for status, apparently signed for by "me". I assume that the delivery man forged my signature as it definitely wasn't mine.

Which service was it? Recorded, RMSD or it could have been Track and trace, track and trace can need a signature but some don't just a confirmation of delivery.

Make your mind up, who lost the case, you or BA?
Or... The police found a number of bottles of whiskey at the premises - they are still working on the case...

I think we agree on that, I'm just a bit surprised that he claimed he'd been victorious without actually getting anything back from anyone and there are still a number of possibilities that he'll end up out of pocket.

Just for you and lovinituk - here is an edited version of the email received from the courier

    Good Afternoon Mr xxxxx

I have contacted the sender and received the Invoice from them for you.

Therefore in order to close this issue I have made the decision to make an ex gratia payment directly to you of £250 which I trust will cover the cost of the case and also for the inconvenience caused to you. This will be by way of an apology and in full and final settlement.

Could you confirm whether you would like this payment made directly into your Bank via a BACS payment or sent as a cheque by post?

I look forward to your response.

Apparently the seller 'decided' they had closed the matter and wanted the courier company to issue a refund directly - it does not bother me as they were going to pay a small compensation either way

So there we have it - I suppose now I will get responses saying it means nothing until I receive the money into my Bank Account but I wanted to make sure you got the information as soon as I did
