Slightly different I had to take British Airways to court after they mislaid my luggage . I lost the case. Good luck and keep up the fight .:cool: hard as nails on the internet . wimp in the real world :cool:0

Please note, you cannot hold something back for 'maximum impact in court'. Should this go to court you will be required to make a full disclosure of evidence well in advance of the hearing, and withholding such evidence may lead to it being ruled inadmissable to your case. Failure to disclose it during the mediation period of a case can also count against you - prejudicial behaviour.
If you have proof, send them it and stop b*ggering about. Make an appointment at the depot with the manager, when the driver can be present. Take your Dad, go in and ask for a copy of the signature. You two can both produce ID with signatures. Give them your other 'evidence'. See what happens.
Or stop trolling. Whichever you choose would be nice.Some days, it's just not worth chewing through the leather straps....

I have been on this site for over 6 years I do not think that qualifies me as anything even near a troll
You may both be very experienced with PayPal and deliveries and the law - I am not - and I have pursued this case using sheer common sense and a strong feeling of injustice
Many people have insinuated various things and I have ignored them (mostly) but one thing is for sure
'Right is might'
I will visit or not visit the Delivery Company when it suits me at this stage I will let things play out - there are procedures to be followed and I will bide my time
So please unfollow the thread so you do not suffer any further pain or disappointment that I may still win this case0 -

I've gone from being initially interested to finding it all quite comical and amusing so I won't be un-following the thread.

The simple way to address this case is either raise a charge back, or change the Paypal case to a SNAD and claim that you received an empty package. Which you will win. This will return the problem to the seller - who after all has the relationship with the carrier.
You dont want to be visiting any one, consulting anyone, or taking anyone to court. It is far more hastle than is required to resolve this in your favour.0 -
Credit card companies don't just hand over money if someone says so, they will surely ask the seller (or paypal in this instance) whether delivery can be proved- seller/paypal says yes and chargeback fails. Am I mistakenn or is it really a case that any of us can use a card to buy an item, tell the card company we want our money back and they just say 'fine here it is?'
Most card companies do pretty much behave like that. If you have reasonable grounds to dispute a transaction in my experience the card company will reverse the transaction with minimal evidence (nothing more than a phone call for Natwest Black card), and the retailer will have to pursue you via the small claims court if you are in the wrong...0 -

Utter dross, neither will work. Try a charge back, there will be an investigation and they will see that you DID receive a package...charge back rejected.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0
