she is constantly in an over draft of 2k and is charged £30 every month for this and can never get out of it as she is paid 1k per month so its never ending

can you really claim money back ???

    leeJ

Erm, no. You can't claim if she's within her limit and the £30 is the charge for using the overdraft. You can only claim back if they've charged you extra for going over the agreed limit.

she just called her bank and they were not willing to help her with her overdraft, and told her she is not entitled to any money back from bank charges, and just offered her a high interest loan for the 2k to get her out of the over draft, think its time to move accounts, maybe shift it to alliance and leicester 0% overdraft for 1 year facility

sod em, i hate banks !!!!!!!!!!
  • Hey
I'm only 19 but im determined to reclaim the overdraft charges I get from my bank, I know a couple are not my fault, but for the couple that ARE my fault that it went over, I'm terrified to come forward with, I have no idea how the legal process works even with the help of this website I'm completely at sea, I can't find all my statements as ( the last 3 months being an exception) I usualy chucked them out after a while ( bad idea, i know that now!). I'm terrified of going to court and having no clue what I'm doing, any advice for a drowning newbie?

Yes... read as much as you can before you do anything.

This site and CAG are two good places to start.

  • Hello there,

I sent off my £10 and letter, etc and actually they have been really good. They sent all the info within 2wks but i have a query or two.

    1) I received the last 14 months statements in duplicate statement form but the do not have the charges on the bottom of each statement, is this normal?

    2) They sent me a summary of charges going back to Jan 04 which came in a spreadsheet type format. It has the Month Of The Charge, No Of Cleared Transaction Charges, Total Unpaid Direct Debit Charges, etc. Can someone confirm what "Total Cleared Transaction Charges" means? I think it means a different type of charge to the unpaid Direct Debits but can someone confirm this as im slightly confused!

    3) Can i add interest onto these charges i.e. Unpaid Direct Debit Charges AND charges for going overdrawn.

Any help would be greatly appreciated.

    Many thanks

You need to read Martin's article, the previous posts in this thread and you'll find what you can and can't claim in the Reclaim Help Thread which is linked in my signature.

    Hi All
I am in the process of reclaiming my charges. I have listed all my charges using the online calculator which is a useful tool. My question is as follows:

The calculator adds interest, which is all good, do I then add the interest charges as listed on my statement, these are all from my overdraft?

Or is the calculator doing this for me?

At the moment Barclays have send a cop of my statements just before the 40 days was up, then received another set 2 days later!! Typical after the complain I made to the Head Office...

Any help would be much apprecited,

    Paul

The interest charges on your statement are not reclaimable.

The interest calculator on the website just calculates 8% statutory interest one the charges themselves.

You can't claim interest until you have made a court claim (well you can but at this stage if you are struggling then treat it as the only interest you can claim).

Thanks for this, I am just about to send them the list which I have printed out. Is it best not to do this now then? Is it worth being safe and just sending the actual charges?
