UKCPS court action
Comments
-
Hi hope someone can help,
I recently received a UKCPS parking charge and initially decided to ignore all correspondence as I had paid for a valid permit where I was staying. The car was unfortunately registered to my mums name and when she saw the letters she got really worried and forced me to respond to them.
I have since responded with several letters back and forth and they are not backing down with the fines; they are still threatening court action.
What would you guys advise. Is it likely that they will take this to court as they have correspondence?
Thanks0 -
They are not 'fines' - of course they will not 'back down' their business model requires everyone to pay.
No, unless you repeatedly park in the same area, it is unlikely you will be taken to court as you would be disputing the charge (for a variety of reasons).
As you have corresponded, they will see you as worth pursuing (as you took them seriously) so simply ride out the letters until they realise you are not going to fork out.0 -

Did they not give you a POPLA code yet? DEMAND a POPLA code seeing as you have been writing and received rejections.
Then if they provide the code, come back and start your own thread about how to word a wining POPLA appeal as discussed here in post #14:

Best to try to get that POPLA code as if you word that appeal properly then UKCPS have to cancel.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What have you told them in the letters though?StupidParkingCompany wrote: »Hi hope someone can help,

If you have informed them you were the driver yet they are still chasing the RK (your mum), then it is they who have the problem not you.0 -
Greetings Friends,
I recently received a letter from UKCPS informing me that, as the registered keeper of my vehicle, that I owed them money for my vehicle being parked in a disabled bay without a valid badge.
The address they provided is for a main road with no parking facilities. I attempted to find the driver of my vehicle for the date indicated and can't track down who it was. There was no ticket issued at the alleged time, nobody has a clue what I'm talking about and no previous mail correspondance prior to warning me to pay or it would go to court.
I wrote back saying that as the registered keeper I wasn't about part with cash on a whim in response to a flakey looking letter without a signatory, any evidence or prior notice etc...
I heard nothing back until...
Now I get a claim form from Northampton (CCBC) parading as Money Claim Online.
The address of the heinous crime is now slightly ammended to rear-of said address and alleging that I have chosen to not name the driver?
But I can't find out who it was? Nobody has a clue where the place is and nobody including me has ever received any notices or tickets? Or Proof?!
What does one do?
Do I have to fight this online via this Northampton County Court, Money Claim Online thingy?
I notice that it is common practice from UKCPS to pick and choose what letters to send and when and to strong arm people into parting with cash when it is not legal to do so!
Any advice please and yes, I am aware that these cowboys monitor this site and others!
Many thanks,

Create your own thread, you have a claim you need specific advice instead of hijacking somebody else's thread from months ago

I had a parking charge last year for parking in disabled bay at a site called Reddragon in Cardiff. Anyway I did what all the forums suggested and ignored all correspondence Off ukcps but was taken to a small claims court to cut a long story short the reprepresentative from ukcps Colin Oxley had photos of thesite entrance where they sign was located and pictures of all they're signs I would have passed on the way to the bay I parked in, needless to say I lost because I don't have a blue badge and ended up with a £255 fine inc court cost. I'm not say pay up but be prepared cause they do take to court and do win I know. From now on I won't park in disabled bays it's changed the way I behave and my outlook on parking on yellow lines and blue badge bays.0

And I guess you did this with no help, and none of the legal arguments used to get this won? A wasted defence no wonder they probably went ahead when they saw the defenceWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you.
